HomeMy WebLinkAboutResolution No. 1739 . :NM RESOLUTION NO. 1739 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING CERTAIN RULES AND REGULATIONS ADOPTED BY THE CHIEF OF POLICE WHEREAS, the Chief of Police, pursuant to provisions of Section 6507 of the Downey Municipal Code, has been authorized by the City Council to adopt certain Regulations as may be reasonably necessary to protect the public peace, health, safety, morals and general welfare of the citizens of Downey in relation to any permit issued for certain businesses, activities, or operations specified in Part 2 of Chapter 5 of Article 6 of the Downey Municipal Code, and; WHEREAS, the Chief of Police has adopted the Rules and Regulations attached hereto, marked "Exhibit A" and by this reference made a part hereof, and; WHEREAS, the Chief of Police has submitted such Rules and Regulations to the City Council for its information and approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. Those certain Rules and Regulations marked "Exhibit A" adopted by the Chief of Police hereby are approved and adopted by the City Council. Further, the City Council finds: 1. That such Rules and Regulations are necessary for the purpose of protecting the public peace, health, safety, morals and general welfare of the citizens of the City of Downey. ' 7 2. That the Chief of Police has reported to the City of Downey that such Rules and Regulations are necessary in order to enable him to adequately supervise places in which live entertainment is carried on and to ensure that the objectives, purposes and intent of Part 2 of Chapter 5 of Article 6 of the Downey Municipal Code will be carried out. SECTION 2. The City Clerk shall certify to the adoption of this resolution. RULE No. 2 - No entertainment or music of any sort shall be per- mitted in any such establishment between the hours of 2 A.M. and 10 A.M. RULE No. 3 - Gambling in any form shall not be permitted or toler- ated. Permitee shall not keep any machine or machines upon the premises designed or commonly used for the purpose of gaming in any form or readily adaptable to such use. RULE No. 4 - No entertainer shall mingle or associate with any patron except when conventionally dressed in street clothes. RULE No. 5 - No entertainment shall be conducted in which any per- former, either entertainer, employee, patron or guest, participating directly or indirectly, sings, speaks any obscene or indecent words, or performs any lewd or indecent acts. RULE No. 6 - No entertainment shall be conducted in which any per - former impersonates by means of costumes or dress a person of the opposite sex. RULE No. 7 - No establishment operating under a Cafe Entertainment Permit shall permit their premises to be used for the purpose of conducting a private club between the hours of 2 A.M. and 10 A.M. RULE No. 8 - Employment of entertainers or employees whose activities or conduct encourages, promotes or condones the congre- gation of homosexuals, lesbians or persons pretending to be such, shall be prohibited. RULE No. 9 - No =MOM employee shall appear in any part of any place for which an Entertainment Permit is issued to which part any member of the public 14,1414itted unless such employee is adequately clothed. No employee shall be deemed to be adequately clothed unless her breasts are covered by an opaque brassiere covering that portion of the breasts below a line extended horizontally through a point 1 inch above the areola. 2616 RULE No. 10 - No female while working as a waitress nor during any shift during which she has been employed as, worked as or acted as a waitress, or for a period of at least one hour thereafter shall,while in such place where she has so acted, worked or been employed, dance either by her- _ self or with any other person or carry on any activity or engage in any actions which purport to be, are for the purpose of, or constitute entertainment. For the purposes of this Rule a working shift shall be four consecutive hours. RULE No. 11 - These Rules shall be posted in a conspicuous place available to entertainers and employees, but need not be in open view to the general public.
