HomeMy WebLinkAboutResolution No. 1737 f RESOLUTION NO. : - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR STREET PURPOSES FOR STAMPS AVENUE. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest and necessity require the acquisition of rights of way in, over and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that, in order to acquire said rights of way in, on, over and under said land for said street purposes and use the same for said purposes, the public interest, convenience and necessity require the acquisition of the rights of way by the City of Downey, in, on, over and under that certain real pro- perty hereinafter described, and the City Council hereby declares it is the intention of the City of Downey to acquire in its name said rights of way in, on, over and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by the public interest, convenience and necessity for the purpose set forth in Sections 1 and 2 here - of, is described as follows: d A portion of the Rancho Santa Gertrudes, in the City of Downey, County of Los Angeles, State of California, as per map recorded in book 1, pages 156 to 158 inclusive of Patents, in the office of the County Recorder of said County, described as follows: Beginning at the Southeasterly corner of Lot 1, Block D, Tract No. 212 in the City of Downey, County of Los Angeles, State of California, as shown on map recorded in book 14, pages 54 and 55 of maps in said office of the County Recorder, said point also being on the Northeasterly line of Tract No. 13304 in said City, County and State, as shown on map recorded in book 342, pages 3, 4 and 5 of maps, in said office of the County Recorder; thence North- westerly along said last mentioned line North 58 ° 43'08" West 36.65 feet to a point which is South 58 ° 43'08" East 0.44 feet from the most Northeasterly corner of Lot 9 of said Tract No. 13304, said point being the beginning of a non - tangent curve concave Easterly, having a radius of 280 feet, a radial line through said point bearing North 55 ° 07'55" West; thence along said curve 19.86 feet through an angle of 4 ° 03'52 "; thence Northeasterly tangent with said curve North 38 ° 55'57" East 91.62 feet; thence Northerly 51.21 feet through an angle of 3 ° 01'29" along a tangent curve concave to the West having a radius of 970 feet; thence Northeasterly tangent with said curve North 35 ° 54'28" East 574.82 feet along a line that is parallel with, and measures 30 feet at right angles from the Easterly lines of Lots 1 and 2 of said Tract No. 212; thence North 25 ° 40'16" East 50.00 feet; thence Northerly and Easterly 132.70 feet through an angle of 108 ° 37'12" along a tangent curve concave to the South, having a radius of 70 feet; thence Southeasterly tangent with said curve South 45 ° 42'32" East 22.36 feet to a point in Westerly line of Lot 15, Tract No. 18036 in said City, County and State, as shown on map recorded in book 527, pages 32 and 33 in said office of the County Recorder, said point being 123.93 feet from the most Northerly corner of Lot 15 of said Tract No. 18036; thence Southwesterly along said line South 35 ° 53'36" West 4.90 feet to the most Westerly corner of said Lot 15; thence South 1 ° 19'40" West 71.34 feet to the Northerly corner of Lot 16 of said Tract No. 18036; thence Northwesterly along the Northerly prolongation of said Lot 16, North 55 ° 56'44" West 48.65 feet; thence Westerly 38.46 feet through an angle of 88 ° 08'48" along a tangent curve concave Southerly, having a radius of 25 feet; thence Southwesterly tangent with said curve along a line that is parallel with and measures 30 feet at right angles from the Easterly line of Lots 1 and 2 of said Tract No. 212, South 35 ° 54'28" West 326.50 feet; thence Southerly 24.71 feet to a poi .rough an angle of 94 ° 22'07" along a tangent curve concave Easterly having a radius o - ).)J feet a radial line through said point bearing South 31 ° 32'21" West, said point being 27.00 feet, measured at right angles, from the North- westerly prolongation of the centerline of Charloma Drive as shown on said Tract No. 18036; thence South 31 ° 32'21" West 27.00 feet along said radial lint to a point on said Northwesterly prolongation, said point being 48.34 feet Southeasterly from the intersection of said Line with the Easterly line of Lots 1 and 2 of said Tract No. 212; thence North 58 ° 27'39" West 6.42 feet along said Northwesterly prolongation of Charloma Drive to a point, said point being 41.92 feet Southeasterly from the intersection of said line with the Easterly line of Lots 1 and 2 of said Tract No. 212; thence South 31 ° 32'21" West 27.00 feet to a point which is 27.00 feet measured at right angles from said Northwesterly prolongation, said point being the beginning of a curve, a radial line to said point bearing North 31 ° 32'21" East; thence Westerly 22.42 feet through an angle of 85 ° 37'53" along a curve concave Southerly having a radius of 15.00 feet; thence Southwesterly tangent with said curve along a line that is parallel with and measures 30.00 feet at right angles from the Easterly line of Lots 1 and 2 of said Tract No. 212 South 35 ° 54'28" West 184.36 feet; thence Southerly 24.71 feet to a point through an angle of 94 ° 22'07" along a tangent curve concave Easterly having a radius of 15.00 feet a radial line through 'said point bearing South 31 ° 32'21" West said point being 25.00 feet measured at right angles, from the Northwesterly prolongation of the centerline of Lubec Street in Tract No. 21673 in said City, County and State, as shown on map recorded in book 596, page 95 of maps in said office of the County Recorder; thence South 31 ° 32'2t' West 25.00 feet along said radial line to a point on said Northwesterly prolongation, said point being 48.19 feet Southeasterly from the intersection of said line with the Easterly line of Lots 1 and 2 of said Tract No. 212; thence North 58 ° 27'39" West 8.00 feet along said North- westerly prolongation of Lubec Street to a point, said point being 40.19 feet Southeasterly from the intersection of said line with the Easterly line of Lots 1 and 2 of said Tract No. 212; thence South 31 ° 32'21" West 25.00 feet to a point which is 25.00 feet measured at right angles from said Northwesterly prolongation, said point being the beginning of a curve, a • radial line to said point bearing North 31 ° 32'21" East; thence Westerly 21.63 feet through an angle. of 82 ° 36'24" along a curve concave Southerly having a radius of 15.00 feet; thence Southwesterly tangent with said curve South 38 ° 55'57" West 83.52 feet; thence 11.95 feet to a point through an angle of 3 ° 06'43" along a tangent curve having a radius of 220.00 feet, said point being on the Northerly line of said Tract No. 13304 Southeasterly 0.58 feet from the most Northerly corner of Lot 8 of said Tract No. 13304 a radial line through said point bearing North 54 ° 10'46" West; thence North 58 ° 27'39" West 28.49 feet along said Northerly tract line to the point of beginning. 2 • 2642 SECTION 4. That the City Attorney of the City of Downey, and Burke, Williams & Sorensen, hereby are authorized, empowered and directed to prepare, institute and prosecute in __ the name of the City of Downey, such proceedings in the proper court having jurisdicition thereof as are necessary for the condemnation of said rights of way in said real property des- cribed in Section 3 of this Resolution. Said attorneys hereby are authorized and empowered to take such procedure as may be necessary to secure an order of immediate possession for the use of and occupancy of said property. SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
