RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY FINDING THAT THE PUBLIC CONVENIENCE AND
NECESSITY REQUIRE THE IMPROVEMENT OF STAMPS
AVENUE IN THE CITY OF DOWNEY (AD 82)
WHEREAS, pursuant to Resolution No. 1695 of the laws and Constitution
of the State of California, a public hearing has been held, duly and regularly,
on the proposed improvement of Stamps Avenue and other streets and rights of
way in the City of Downey, by the acquisition of right of way and construction
of concrete curbs, gutters, driveway aprons, asphaltic concrete pavement,
water lines and sewers and appurtenant work thereto; and
WHEREAS, said improvement has been considered fully;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the City Council of the City of Downey hereby finds and
determines that the public convenience and necessity require the improvement
of Stamps Avenue, Suva Street, Lubec Street and Charloma Drive, the acquisition
of right of way necessary for such street and the improvement thereof by the
construction of concrete curbs, gutters, driveway aprons, asphaltic concrete
pavement, water lines and sewers, all as shown on Plan No. 1- 16 -25, Right of
Way Map No. 82 -R, Specification No. AD 82, all approved by Resolution No. 1697
of the City Council of the City of Downey, adopted March 14, 1966, and any
work appurtenant thereto. The nature, location and extent of the proposed
improvement district to be assessed for the cost and expenses thereof is shown
on Assessment District Map No. 82 -B, adopted March 14, 1966, by Resolution No.
1698 of the City of Downey.
SECTION 2. That the "Special Assessment Investigation, Limitation and
Majority Protest Act of 1931" shall not apply to the making of said improve-
ment.
SECTION 3. That this improvement shall be conducted under the Improve-
ment Act of 1911, which is Division 7 of the Streets and Highways Code of
the State of California. The City Engineer and the City Attorney hereby are
instructed to present to the City Council the Resolution of Intention required
by the Improvement Act to initiate the proceedings for the improvement.
SECTION 4. The City Clerk shall certify to the adoption of this reso-
lution, and thenceforth and thereafter the same shall be in full force and
effect.
