RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY AMENDING THE LAND USE MAP
OF THE GENERAL PLAN BY CHANGING THE LAND
USE DESIGNATION OF FOUR PARCELS TO
GENERAL COMMERCIAL FOR PROPERTY AT 10801
STUDEBAKER, 10807 -21 STUDEBAKER, 11136
DOLLISON AND THE 12000 BLOCK OF FLORENCE
AVENUE AND APPROVING AND CERTIFYING THE
NEGATIVE DECLARATION
GENERAL PLAN AMENDMENT 91 -23
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Downey
does hereby find, determine and declare that:
A. The City of Downey initiated a General Plan
Amendment for four parcels in northeastern Downey,
in that area proposed to be regulated by Specific
Plan 90 -1. The proposed Land Use Designation of
all four parcels is General Commercial; and
B. Parcel One is located in the 11200 block of
Florence Avenue and is currently used as an on -ramp
for the southbound Santa Ana Freeway. It has no
assessor's parcel number. The land is currently
designated for Public uses in the General Plan.
The General Commercial designation is sought so
that the land may be developed commercially in the
event it is ever sold as surplus by its owner, the
State Department of Transportation; and
C. Parcels Two and Three are located at 10801 and
10807 -21 Studebaker Road. (8020- 006 -304 and -036).
Their current Land Use designation is Low Medium
Density Residential, although both have been
developed with commercial uses for eighteen
years. The requested designation would correspond
to the existing land use and correct the current
inconsistency; and
D. Parcel Four is approximately 4.9 acres of the

6.1 acre parcel at 11136 Dollison Drive

(8019- 006 -013). This area is currently developed
as a storage parking area for two vehicle
dealerships. Its General Plan designation is Low
Density Residential. The proposed designation
corresponds more closely with the existing use.
The construction of additional structures in this
area will be limited by the existing Open Space
zoning and the proposed zoning and development
requirements of Specific Plan 90 -1. The remainder
of the parcel is already designated General
Commercial; and
E. The Planning Commission held a duly noticed
public hearing on this proposal on April 3 and
April 17, 1991, and recommended that the City
Council adopt a resolution amending the general
plan as proposed; and
F. The City Council held a duly noticed public
hearing on this request on June 11, 1991, and fully
considered all oral and written testimony and facts
and opinions offered at that hearing; and
G. This amendment and revision to the Downey
General Plan is consistent with good planning
practice, necessary and desirable for the
development of the community and necessary for the
preservation of the public health, safety, and
general welfare of the City of Downey; and
H. The City Council has considered the effects of
the decision on the housing needs of the region in
which the City is located and balanced those needs
against the public service needs of the City
residents and available fiscal and environmental
resources; and
I. An Initial Study of Environmental Impact and a
Negative Declaration have been prepared for this
General Plan Amendment in accordance with the
provisions of the California Environmental Quality
Act, the State CEQA Guidelines, and the City of
Downey's Revised Environmental Procedures; and
J. Prior to making the recommendations of this
Resolution, the City Council of the City of Downey
considered the Initial Study of Environmental
Impact and the Negative Declaration together with
any comments received during the public review
process and at the hearings; and

Based upon the Initial Study and any comments
received in the public review process, there is no
substantial evidence that the General Plan
Amendment will have a significant adverse effect
upon the environment.
SECTION i. The City Council hereby certifies and
approves the Negative Declaration for the General Plan
Amendment attached to this Resolution as Attachment A and by
this reference incorporated herein.
SECTION 2. The City Council hereby amends the Land
Use Map of the Downey General Plan by changing the existing
designations of Public, Low Medium Density Residential, and
Low Density Residential to General Commercial for each of
the subject properties.
SECTION A. The City Clerk shall certify the
adoption of this Resolution.
PASSED, APPROVED AND ADOPTED this 11th day of

referenced project in accordance with guidelines for the implementation of the California
environmental Quality Act. Based on this Initial Study, a copy of which is attached,
Negative Declaration status is granted for this project because it is found that
® there is no substantial evidence that the project may have a significant effect
on the environment.
0 revisions have been incorporated into the project to avoid significant effects
on the environment which could otherwise occur. These are specified as
mitigation measures in the Initial Study.
This determination is not final until approved by the decision - making body.
0 NOTICE OF DETERMINATION
The above - referenced project was approved.on (date)

As stated in the above Negative Declaration, it has been determined that the project will
not have a significant effect on the environment.
