HomeMy WebLinkAboutResolution No. 5410 RESOLUTION NO. 5410 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY RECOMMENDING AN AMENDMENT TO THE HOUSING CHAPTER OF THE GENERAL PLAN BY EXPANDING SECOND UNIT DEVELOPMENT OVERLAY AREA #17, FOR PROPERTIES LOCATED AT 12433 & 12432 PARROT AVENUE AND 12444 & 12450 PARAMOUNT BOULEVARD, DOWNEY, AND RECOMMENDING CERTIFICATION AND APPROVAL OF THE ^ NEGATIVE DECLARATION THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey does hereby find, determine and declare that: A. An application has been filed by Paul DiGerolami (hereinafter "Applicant ") for an amendment to the Housing Chapter of the General Plan by expanding Second Unit Development Overlay Area #17, for properties located at 12432 & 12433 Parrot and 12444 & 12450 Paramount Boulevard, City of Downey (hereinafter "Subject Property "). The legal description of the Subject Property is attached hereto as Exhibit "A ", and incorporated herein by this reference as if set forth in full; and B. The City Council held a duly noticed public hearing on the application on March 12, 1991, and fully considered all oral and written testimony and facts and opinions offered at the aforesaid public hearing; and C. The amendment and revision to the Downey General Plan as recommended in this Resolution is consistent with good planning practice, necessary and desirable for the development of the community and necessary for the preservation of the public health, safety and general welfare of the City of Downey; and D. The City Council has considered the effects of the decision on the housing needs of the region in which the City is located and balanced those needs against the public service needs of the city residents and available fiscal and environmental resources; and E. An Initial Study of Environmental Impact and a Negative Declaration have been prepared for this General Plan Amendment in accordance with the provisions of the California Environmental Quality Act, the State CEQA Guidelines and the City of Downey's Revised Environmental Procedures; and F. Prior to making the recommendations of this Resolution, the City Council of the City of Downey considered the Initial Study of Environmental Impact and the Negative Declaration together with any comments received during the public review process and at the hearings; and G. Based upon the Initial Study and any comments received in the public review process, there is no substantial evidence that the General Plan Amendment will have a significant adverse effect upon the environment. SECTION 2. The City Council hereby certifies the Housing Chapter of the General Plan to expand the Second Unit Development Overlay Area #17 for the Subject Properties. SECTION 3. The City Council hereby certifies and approves the Negative Declaration for the General Plan Amendment attached to this Resolution as Exhibit "B ". Based on this Initial Study, a copy of which is attached, Negative Declaration status is granted for this project because it is found that c 5i1 there is no substantial evidence that the project may have a signifi- cant effect on the environment. revisions have been incorporated into the project to avoid significant effects on the environment which could otherwise occur. These are specified as mitigation measures in the Initial Study. This determination is not final until approved by the decision - making body.
