A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DOWNEY AMENDING THE UTILITY USERS
TAX RULES OF ADMINISTRATION AND PROCEDURES
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That Part E of the City of Downey Utility Users' Tax Rules
of Administration and Procedures is hereby amended as follows:
"Part. E
Exemption from Tax -- Hardship Cases
Section 11. Claim Procedure by Utility Customers. Utility customers
who believe that the Utility Users' Tax is a hardship may submit an
application to the Finance Director as prescribed in Section 12.
Section 12. Hardship Cases, Application for Exemption.
A. General. Downey Municipal Code, Section 6195 (d) authorizes relief
from the Utility Users' Tax in hardship cases.
B. Eligibility. Exemption of tax under this authority shall be
allowed upon submission of statement made under penalty of perjury
that shows a person qualifies for the City's Trash Rebate Program
or is within the poverty threshold established by the federal
government.
C. Form of Claim. The Director of Finance shall provide claim forms
as he deems useful to utility customers. Claimants shall complete
the form in full and return the form to the Director of Finance.
The claim should include written records and statements evidencing
claimant's eligibility for exemption.
D. Processing of Claim. After the Director of Finance reviews the
claim, he shall notify the claimant whether claimant is eligible
for exemption. If the claimant is eligible, then the Director
shall also notify the utility companies.
Section 13. Denial of Claim, Administrative Remedy. Claimants whose
application is rejected may file a written application for appeal, within 15
days from the date the rejection notice is mailed, with the City Clerk's
Office. The application shall contain the reasons for the appeal. The City
Clerk shall set the time and place of a hearing before the City Manager, or
his designee, to hear the appeal. The designee may not be the Director of
Finance or any person whom he supervises. The decision of the City Manager or
his designee is final."

SECTION 2. The City Clerk shall certify to the adoption of this
Resolution.
