RESOLUTION NO.4 19'
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY UPHOLDING THE REVOCATION OF A POOL
HALL PERMIT
WHEREAS, the City Council of the it of Downey sitting

in a regular session in the Council Chambers of the City Hall
in the City of Downey on January 25, 1966, at the hour of
8:30 a. m. held a hearing to determine whether the revocation

of a pool hall permit issued for The Golden Cue in the City
of Downey should be sustained; and
WHEREAS, Mr. R. E. Wittick, the owner of The Golden Cue,
was present; and
WHEREAS, the case was presented on behalf of the City
by the City Attorney, Royal M. Sorensen; and
WHEREAS, evidence both oral and documentary was introduced;
and
WHEREAS, the City Council after hearing all of the evidence
and argument by the City Attorney and by Mr. Wittick in his own
behalf by motion duly adopted upheld the revocation of such
permit by the Chief of Police ;and
WHEREAS, the City Council is desirous of ratifying said
action by this resolution;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby finds that on May 14,
1965, a permit was issued to The Golden Cue at 11026 South
Downey Avenue, Downey, California for the purpose of operating
a pool table and pool hall.
That on November 3, 1965, November 4, 1965, and November 5,
1965, open gambling transpired with the exchange of money involved

in The Golden Cue as a result of the betting upon pool games
or billiard games.
That Mr. Kurt Skoda, the person managing The Golden Cue
at the time, had knowledge of the gambling and knew that the
games were being carried on at stated times and for stated
sums.
A complaint was issued against Mr. Skoda charging him
with violation of Sections 4402 and 4k03 of the Downey
Municipal Code.
That on November 15, 1965, Mr. Skoda appeared in Division
2 of the Downey Municipal Court and plead guilty to Sections
4402 and 4403 of the Downey Municipal Code.
That on December 10, 1965, the Chief of Police sent a
notice to Mr. Wittick revoking his permit and on December 15,
1965, Mr. Wittick filed a Notice of Appeal staying the revoca-
tion of the permit.
By reason of the foregoing findings, the City Council
concludes that there was a violation of the rules governing
the operation of pool halls pursuant to the permit; and that
the business was carried on in an illegal and improper manner
and the person in charge of such business violated a law of the
City.
SECTION 2. It hereby is determined that the revocation of
the pool hall permit for The Golden Cue by the Chief of Police
is upheld and the action of the City Council taken in this
respect on January 25, 1965, hereby is ratified and affirmed.
SECTION 3. The City Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be
in full force and effect.
