HomeMy WebLinkAboutResolution No. 1670 2522 RESOLUTION NO. /6) ;;G, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR STREET PURPOSES ON THE WEST SIDE OF BROOKSHIRE AVENUE BETWEEN ORANGE STREET AND EUCALYPTUS STREET THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest and necessity require the acquisition of rights -of -way in, over and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and located in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that, in order to acquire said rights -of -way in, on, over and under said land for said street purposes and use the same for said purposes, the public interest, conven- ience and necessity require the acquisition of the rights -of -way by the City of Downey, in, on, over and under that certain real ro ert hereinafter described, P p y abed and the City Council hereby declares it is the intention of the City of Downey to acquire in its name said rights -of -way in, on, over and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by the public interest, convenience and necessity for the purpose set forth in Sections 1 and 2 hereof, is described as follows: Parcel 7: That portion of Lot 33, Tract No. 2723, as per Map recorded in Book 27, Page 84 of Maps, in the Office of the County Recorder of said County, described as follows: Beginning at the most easterly corner of said Lot 33; thence South 32 ° 42' West, 157.75 feet along the southeasterly line of said Lot, to the inter- section of the northeasterly line of said land described in deed to Anthony Sgro and Dorothy M. Sgro, recorded November 28, 1952, as Document No. 86, in Book 40398, Page 12 of Deeds, in the Office of the County Recorder of said County; thence North 58 ° 52' West, 1501. feet along said northeasterly line to a point in a line that is parallel with and distant 15.00 feet; measured at right angles from the southeasterly line of said Lot; thence along said parallel line, North 32 ° 42' East, 136.24 feet to the beginning of a tangent curve concave to the West, having a radius of 15.00 feet; thence northwesterly along said tangent curve, 24.37 feet; throgh a central angle of 93 ° 05' to a point of tangency with a line that is parallel with and distant 5.00 feet, measured at right angles from the northeasterly line of said Lot; thence North 29 ° 37' East 5.00 feet to a point in the northeasterly line of said Lot; thence South 60 ° 23' East, 31.12 feet along said northeasterly line to the point of beginning. Parcel 8: That portion of Lot 33 in Tract No. 2723, in the County of Los Angeles, State of California, as per Map recorded in Book 27, Page 84 of Maps, in the Office of the County Recorder of said County, described as follows: The southeasterly 15.00 feet of the northeasterly 54.48 feet of the south- westerly 188.97 feet of said Lot 33, Tract No. 2723. Parcel 9: That portion of Lot 33 Tract No. 2723, in the City of Downey, County of Los Angeles, State of California, as per Map recorded in Book 27, Page 84 2523 of Maps, in the Office of the County Recorder of said.. County described as follows: The southeasterly 15.00 feet of the northeasterly 54.48 feet of the southwesterly 134.49 feet of said Lot 33, Tract No. 2723. Parcel 10: That portion of the northeasterly 50.01 feet of the southwesterly 80.01 feet of Lot 33, Tract No. 2723, as per Map recorded in Book 27 Page 84 of Maps, in the Office of the County Recorder of said County, described as follows: Commencing at the most southerly corner of said Lot 33; thence North 32 ° 42' East 30.01 feet along the southeasterly line of said Lot to the true point of beginning; said point being 30.00 feet measured at right angles from the easterly prolongation of the southwesterly line of said Lot; thence continuing North 32 ° 42' East along said southeasterly line 50.03 feet to the intersection of the southwesterly line of land described in deed to Blanche McMartin, recorded December 23, 1952, as Document No. 736, Book 40580, Page 188 of Deeds in the Office of the County Recorder of said County; thence North 58 ° 52' West 15.01 feet along said southwesterly line to a point in a line that is parallel with and distant 15.00 feet, measured at right angles, from the southeasterly line of said Lot; thence along said parallel line South 32 ° 42' West 35.43 feet to the beginning of a tangent curve concave to the North having a radius of 15.00 feet; thence southwesterly, 23.15 feet along said curve through a central angle of 88 ° 26' to a point of cusp with a line that is parallel with and distant 30.00 feet, measured at right angles, from the southwesterly line of said Lot; thence South 58 ° 52' East 29.61 feet to the true point of beinning. Parcel 11: That portion of Lot 47, Tract No. 2723, as per Map recorded in Book 27, Page 84 of Maps, in the Office of the County Recorder of said County, described as follows: Beginning at a point in the southwesterly line of said Lot 47, that is South 32 ° 42' West, 30.01 feet along said southeasterly line from the most easterly corner of said Lot; thence continuing South 32 ° 42' West, along said southeasterly line 78.47 feet to the intersection of the northeasterly line of property described in Deed to Charles H. Pattan, Recorded March 9, 1965, as Document No. 2252 of Deeds, in the Office of the County Recorder of said County; thence northwesterly along said northeasterly line, to a point in a line that is parallel with and distant 15.00 feet, measured at right angles from said southeasterly line of said Lot; thence North 32 ° 42' East 62.95 feet, along said parallel line to the beginning of a tangent curve, concave to the West, having a radius of 15.00 feet; thence north- westerly along said curve, 23.97 feet through a central angle of 91 ° 33'47" to a point of cusp with a line that is parallel with and distant 30.00 feet, measured at right angles to the northeasterly line of said Lot; thence South 58 ° 51'47" East 30.42 feet along said line to the point of beginning. SECTION 4. That the City Attorney of the City of Downey, and Burke, Williams and Sorensen, hereby are authorized, empowered and directed to prepare, institute and prosecute in the name of the City of Downey, such proceedings in the proper court having jurisdiction thereof as are necessary for the condemnation of said rights -of -way in said real property described in Section 3 of this Resolution. Said attom eys hereby are authorized and empowered to take such procedure as may be necessary to secure an order of immediate possession for the use of and occu- pancy of said property. SECTION 5.
