RESOLUTION NO. 1 3C
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
MAKING FINDING OF FEASIBILITY OF ACQUISITION OF NECES-
SARY RIGHTS OF WAY AND THE CONSTRUCTION OF CURBS , GUTTERS,
AND PAVEMENT IN ASSESSMENT DISTRICT NO. AD -41 (POMERING
ROAD AND OTHER STREETS)
WHEREAS, the hearing on the Special Assessment Investigation Report for
the proposed improvement of Pomering Road and other streets by the acquisi-
tion of necessary rights of way and construction of improvements has been
conducted by the City Council of the City of Downey; and
WHEREAS, the City Council has considered said investigation report, as
required by Division 4 of the Streets and Highways Code of the State of
California; and
WHEREAS, protests made or filed against this proceeding represent less
than 50% of the assessable area of the district proposed to be assessed for
said improvement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That all protests to said report or improvement heretofore
made or filed hereby are overruled and denied.
SECTION 2. That the public interest, convenience, and necessity require
the acquisition and improvement substantially as set forth in said report,
and the project is feasible, and the lands to be assessed for said acquisition
and improvement will be able to carry the burden of such proposed assessments.
SECTION 3. That the limitations on the amounts of assessments as
prescribed by said Division 4 may be disregarded, both with respect to the
limitations on the district as a whole and as to the limitations on the
individual specific assessments.
SECTION 4. The City Clerk shall certify to the adoption of this resolution,
and thenceforth and thereafter the same shall be in full force and effect.
