HomeMy WebLinkAboutResolution No. 1634 - 21:75 RESOLUTION No. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECES- SITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR STREET PURPOSES AT THE NORTHWESTERLY CORNER OF PARAMOUNT BOULEVARD AND THIRD STREET ^ THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest and necessity require the acquisition of rights of way in, over and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and lo- cated in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that, in order to acquire said rights of way in, on, over and under said land for said street purposes and use the same for said purposes, the public interest, convenience and necessity require the acquisition of the rights of way by the City of Downey, in, on, over and under that certain real property hereinafter described, and the City Council hereby declares it is the intention of the City of Downey to acquire in its name said rights of way in, on, over and under said hereinafter described real property by condemnation in accordance with the pro- visions of the Code of Civil Procedure and the Constitution of the State of California atthorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by the public interest, convenience and necessity for the purpose set forth in Sections 1 and 2 hereof, is described as follows: That portion of Lot A of the Rives Tract, in the City of Downey, County of Los Angeles, State of California, as per map recorded in Book 8 page 177 of Maps, in the Office of the County Recorder of said County, described as follows: Beginning at a point in the Northwest line of College Avenue, now Paramount Boulevard, a County Road, being 33.00 feet in width, as shown on Tract No. 8960, recorded in the office of the County Recorder of said County, distant Northeasterly 310.00 feet from the most Southerly corner of said Lot A; thence North 58 ° 22'10" West 353.50 feet along a line parallel with and distant North- easterly 30.00 feet, measured at right angles from the Southwesterly line of Third Street, as shown on said map of Tract No. 8960, to the Southwesterly prolongation of the Southeasterly line of Lot 52 of said Tract No. 8960; thence North 31 ° 25'50" East 30.00 feet thereon to the Northeasterly line of said Third Street; thence South 58 ° 22'10" East along the Southeasterly prolongation of said Northeast line of Third Street, 304.84 feet to the beginning of a tangent curve concave to the Northwest, having a radius of 15.00 feet; thence Southeasterly along said tangent curve, an arc distance of 23.61 feet through an angle of 90 ° 12'00" to a tangent point in a line that is parallel with and distant Northwesterly 33.50 feet; when measured at right angles, from the Northwest line of said College Avenue, 33.00 feet wide; thence North 31 ° 25'50" East 99.77 feet along said last mentioned parallel line to the Southwest line of the land conveyed to Tobette Enterprises Inc., recorded in Book D382 page 654 of Official Records of said County; thence South 58 ° 22'10" East 33.50 feet along said Southwesterly line of the land of Tobette Enterprises, Inc., to the Northwesterly line of said College Avenue, 33.00 feet wide; thence Southwesterly 145.00 feet along said Northwesterly line of College Avenue to the point of beginning. '6 SECTION 4. That the City Attorney of the City of Downey, and Burke, Williams and Sorensen, hereby are authorized, empowered and directed to prepare, institute and prosecute in the name of the City of Downey, such proceedings in the proper court having jurisdiction thereof as are nec- essary for the condemnation of said rights of way in said real property described in Section 3 of this Resolution. Said attorneys hereby are authorized and empowered to take such pro- ^ cedure as may be necessary to secure an order of immediate possession for the use of add occupancy of said property. SECTION 5. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this day of 1 - L , 1965.
