A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY UPHOLDING THE REVOCATION OF AN
ENTERTAINMENT PERMIT FOR THE MELODY ROOM
WHEREAS, the City Council of the City of Downey sitting
in a regular session in the Council Chambers of the City Hall
in the City of Downey on September 28, 1965, at the hour of
9:00 a. m. held a hearing to determine whether the revocation
of an entertainment permit issued for the Melody Room in the
Cit y Downey of Downey should be sustained and
WHEREAS, Mr. Harold L. Marco and Mr. David L. West, owners
of the Melody Room, were present and were represented by
Richard A. Donnelly, an attorney at law; and
WHEREAS, the case was presented on behalf of the City by
the City Attorney Royal M. Sorensen; and
evidence both oral and documentary was introduced;
WHEREAS, ,

WHEREAS, the City Council after hearing all of the evidence
and argument by both counsel by motion duly adopted upheld the
revocation of such permit by the Chief of Police; and
WHEREAS, the City Council is desirous of ratifying said
action by this resolution;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES
RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby finds:
1. That on May 14, 1965, an entertainment permit was issued
to the Melody Room at 12161 -5 Paramount Boulevard, Downey,
California. A copy of said permit being marked City's Exhibit 1
in the files of the City Clerk.

2. That at or about the time the permit was issued a
copy of the police rules governing cafe entertainment, marked
City's Exhibit 2 and on file in the office of the City Clerk,
was delivered to Mr. West.
3. That by letter dated August 26, 1965, the Chief of
Police gave notice of revocation of the entertainment permit
to Mr. Harold L. Marco and Mi. David L. West of the Melody Room.
A copy of such notice of revocation is attached hereto marked
Exhibit A and by this reference made a part hereof.
4. That on June 25, 1965, a female entertainer in the
Melody Room dressed in a scanty costume (not conventional
street clothes) danced with one of the customers.
5. That on August 21, 1965, certain girls danced as
entertainers in the Melody Room and while still wearing the
costumes in which they danced, such costumes not being conventional
street clothes, mingled with and served drinks to the customers
and did solo dances within the area ordinarily reserved for the
customers.
6. That on August 24, 1965, females dressed in scanty
costumes danced in the Melody Room on a small stage and then
returned to serving drinks to the customers and circulating and
mingling in and with the customers.
7. That on June 29, 1965, Mr. Marco was advised by detective
George Snyder of the Downey Police Department that the activities
of the waitresses could constitute a violation of the City's
Exhibit 2 and could be grounds for revoking his entertainment
permit.
8. That on August 21, 1965, Sgt. Soule questioned Mr. West
concerning the posted entertainment permit; that the entertainment
permit was found in a drawer; and that Mr. West subsequently was
cited for and was convicted of a violation of Section 6405 of the
Downey Municipal Code.

9. That on August 21, 1965, Sgt. Soule observed
customers dancing and the dance floor did not have the
required square footage as prescribed by Section 6507.6 of
the Downey Municipal Code.
10. That the dances performed by the girls while dancing
on the stage and as a solo were of the kind commonly referred
to as the "bumps and grinds" and were lewd and suggestive.
By reason of the foregoing findings of fact, the City
Council concludes that there was a violation of Rule No. 4
of the police rules governing cafe entertainment; that there
was a violation of Section 6405 and Section 6507.6 of the
Downey Municipal Code; and that the entertainment was carried
on in an improper manner.
SECTION 2. It hereby is determined that the revocation
of the entertainment permit for the Melody Room by the Chief
of Police is upheld and the action of the City Council taken
in this respect on September 28, 1965, hereby is ratified and
affirmed.
SECTION 3. The City Clerk shall certify to -the adoption
of this resolution, and thenceforth and thereafter the same
shall be in full force and effect.
