A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO VACATE A PORTION OF CHEROKEE
DRIVE EASTERLY OF WILEY BURKE AS SHOWN ON TRACT NO. 17580
AS PER MAP RECORDED IN BOOK 451, PAGES 37 THROUGH 40 of
MAPS IN THE OFFICE OF THE COUNTY RECORDER, COUNTY OF LOS
ANGELES, STATE OF CALIFORNIA
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Downey upon recommendation
of the Planning Commission hereby declares its intention to vacate that portion
of Cherokee Dr. Easterly of Wiley Burke as shown at the Northeasterly corner
of Lot 283 of Tract No. 17580 on Map on file in the office of the City Clerk,
to which reference is made for further particulars. This area to be vacated
being described as follows:
That portion of Cherokee Drive, in the City of Downey, County of
Los Angeles, State of California, shown on Map of Tract 17580
recorded in Book 451, Pages 36 through 40 of Maps in the office
of the County Recorder of said County described as follows:
Beginning at the most Easterly corner of Lot 283 of said Tract
17580; thence along the Northeasterly prolongation of the South-
easterly line of said Lot North 31 ° 06'05" East 15.00 feet to the
Southeasterly prolongation of the most Northeasterly line of said
Lot; thence North 58 ° 53'55" West thereon 35.00 feet to a point of
cusp with a tangent curve concave Westerly and having a radius of
15.00 feet as shown on Map; thence Southerly thereon 23.56 feet to
the most Southesterly line of Cherokee Drive as shown on said Map;
thence South 58 ° 53'55" East thereon 20.00 feet to the point of
beginning.
SECTION 2. Pursuant to the authority of Sections 8330 and 8331 of the
Streets and Highways Code of the State of California, the City Council hereby
determines that the public convenience and necessity require the reservation
of a permanent easement to construct, maintain, operate, replace, remove, renew
and enlarge lines of pipe, conduits, cables, wires, poles and other convenient
structures, equipment and fixtures for the operation of gas and water pipe lines,
telephone lines and for the transportation of electric energy in, upon and across
the street or part thereof hereinbefore described, proposed to be vacated.
All proceedings for the vacation of said street are taken and shall be
subject to the reservation of said described easement.
SECTION 3. The hour of 8:00 A.M. on the 27th day of July, 1965,ia hereby
fixed as the time, and the City Council Chambers in the City Hall at 8425 Second
Street, Downey, California, is hereby fixed as the place for hearing all persons
interested in objecting to the proposed vacation of said street.
SECTION 4. The City Clerk shall cause this resolution to be published in
the manner required by Section 8322 of the Streets and Highways Code of the
State of California.
SECTION 5. Notices of the proposed Street Vacation shall be posted in the
manner prescribed by said Section 8322.
SECTION 6. The City Clerk shall certify to the adoption of this resolution.
