HomeMy WebLinkAboutResolution No. 1582 2 RESOLUTION NO.//5/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING A VACATION OF A PORTION OF SEVENTH STREET LYING WESTERLY OF LAKEWOOD BOULEVARD WHEREAS, by Resolution No. 1571 the City Council of the City of Downey adopted the 22nd day of June, declared its intention to vacate that portion of Seventh Street located at the Northwest corner of Seventh Street and Lakewood Boulevard. WHEREAS, the public hearing on said intended vacation duly was held and a full and fair hearing was had thereon. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey finds from all the evidence submitted at said hexing that that portion of Seventh Street herein- after described is unnecessary for present or prospective street purposes, and it is hereby ordered vacated. Said area so vacated is described as follows: Beginning at the southwesterly terminus of that certain course being a bearing of North 31 ° 48'15" East and a length of 274.97 feet in the southeasterly line of Marbel Avenue, as shown on the map of said tract; thence along said southeasterly line North 31 ° 48'15" East 7.98 feet; to the beginning of a curve concave easterly tangent to said last mentioned course and having a radius of 15.00 feet; thence southwester - ly, southerly and southeasterly along said curve through a central angle of 89 ° 54'22" an arc distance of 23.54 feet to its point of tangency with a line that is parallel with and distant 10.00 feet northeasterly, measured at right angles, from that certain course having a bearing of North 58 ° 06'07" West in the northeasterly line of Seventh Street as shown on said tract and its northwesterly prolongation; thence along said parallel line, South 58 ° 06'07" East 155.03 feet to the beginning of a curve concave southwesterly tangent to said last mentioned course and having a radius of 130.00 feet; thence southeasterly along said last mentioned curve through a central angle of 18 ° 51'52" an arc distance of 42.80 feet; thence tangent to said last mentioned curve, South 39 ° 14'15" East 9.34 feet to a point in the northeasterly line of said Seventh Street as shown on said map; said last mentioned point being the true point of beginning; thence continuing South 39 ° 14'15" East 39.26 feet to the begin- ning of a curve concave northeasterly tangent to said last mentioned course and having a radius of 70.00 feet; thence southeasterly along said last mentioned curve through a central angle of 18 ° 51'52" an arc distance of 23.05 feet; thence tangent to sAid last mentioned curve, South 58 ° 06'07" East 48.42 feet to the beginning of a curve concave northerly and having a radius of 14.72 feet; thence southeasterly, easterly and northeasterly along said last mentioned curve through a central angle of 96 ° 48'16" an arc dis- tance of 21.91 feet to its point of tangency with the northwesterly line of Lakewood Boulevard, 100.00 feet wide, as shown on said map, at its point of int rsection with the northeasterly line of Seventh Street as said inter- secilltion shown on said map; thence along said northeasterly line North 58°A West 122.81 feet to the true point of beginning. SECTION 2. Pursuant to the authority of Sections 8330 and 8331 of the Streets and Highways Code of the State of California, the City Council hereby determines that the public convenience and necessity require the reservation of a permanent easement to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas and water pipe lines, telephone lines and for the transportation of electric energy in, upon and across the street or part thereof herinbefore described, proposed to be vacated. All proceedings for the vacation of said street are taken and shall be subject to the reservation of said described easement. SECTION 3. The City Clerk shall certify to the adoption of this resolution and cause a certified copy thereof, attested by the City Clerk under theEea1 of the City of Downey, to be recorded in the office of the County Recorder of the County of Los Angeles.
