HomeMy WebLinkAboutResolution No. 1555 (") IR RESOLUTION NO. � A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF A PORTION OF IMPERIAL HIGHWAY AND PARAMOUNT BOULEVARD AT THE S OUTHEAS T CORNER OF THE INTERSECTION OF IMPERIAL HIGHWAY AND PARAMOUNT BOULEVARD AS SHOWN ON TRACT NO. 14173 •--1 WHEREAS, by Resolution No. 1533 the City Council of the City of Downey adopted the 23rd day of March, 1965, declared its intention to vacate that portion of the south side of Everest Street and Paramount Boulevard located at the southeasterly corner of the intersection of Imperial Highway and Paramount Boulevard as shown on map in the files in the office of the City Clerk; and WHEREAS, the public hearing on said intended vacation duly was held and a full and fair hearing was had thereon. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey finds from all the evidence submitted at said hearing that that portion of Imperial Highway and Paramount Boulevard located at the southeasterly corner of the intersection of Imperial Highway and Paramount Boulevard, as shown on Tract No. 14173 here- inafter described is unnecessary for present or prospective street purposes, and it is hereby ordered vacated. Said area so vacated is described as follows: Described as a portion of Tract No. 14173, in the City of Downey, County of Los Angeles, State of California, dedicated for public use, on Map recorded in Book 293, Pages 5 through 8 of Maps in the office of the County Recorder of said county, described as follows: Beginning at the northerly corner of Lot 2 of said Tract; thence along the northeasterly line of said lot and prolongation thereof, South 59 ° 03'36" East 162.04 feet to the prolongation of the southeasterly line of said Lot; thence North 32 ° 08'54" East thereon 32.01 feet to a line parallel with and 50.00 feet southwesterly, measured at right angles from the centerline of Imperial Highway as shown on said Map; thence North 59 ° 03'36" West thereon 324.42 feet to the beginning of a tangent curve concave southerly and having a radius of 15.00 feet; thence westerly thereon 23.23 feet to a point y P of tangency to a line parallel with and 50.00 feet southeasterly, measured at right angles from the centerline of Paramount Boulevard as shown on said Map; thence South 32 ° 11'45" West thereon 220.12 feet to the beginning of a tangent curve concave easterly and having a radius of 15.00 feet; thence southerly thereon 23.57 feet to a point of tangency to the prolongation of the southeasterly line of Lot 1 of said Tract; thence South 57 ° 51'06" East thereon 15.00 feet to a point of cusp with that certain tangent curve, concave easterly and having a radius of 15.00 feet shown on said Map as a portion of the boundary of said Lot 1; thence along said curve and the north- westerly, northerly and northeasterly boundaries of said Lot 1 to the point of beginning. SECTION 2. Pursuant to the authority of Section 8330 and 8331 of the Streets and Highways Code of the State of California, the City Council hereby determines that the public convenience and necessity require the reservations of a permanent easement and right at any time, or from time to time, to con- struct, maintain, operate, replace, remove, and renew sanitary sewers and appurtenant structures in, upon, over and across the street or part thereof, proposed to be vacated, and maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures and fixtures for the operation of gas pipe lines, telegraph and telephone lines, and for the transportation and distribution of electrical energy, water, and incidental purposes, including access and the right to 23 �w keep the property free from flammable materials and weed growth, and otherwise protect the same from all hazards, in, upon, and over that portion of the street proposed to be vacated and described hereinabove. All proceedings for the vacation of said street are taken and shall be subject to the reservation of said described easement. SECTION 3. The City Clerk shall certify to the adoption of this resolution and cause a certified copy thereof, attested by the City Clerk under the Seal of the City of Downey, to be recorded in the office of the County Recorder of the County of Los Angeles.
