HomeMy WebLinkAboutResolution No. 1538 235 RESOLUTION NO. 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF A PORTION OF FARM STREET AND MYRTLE STREET AS SHOWN ON TRACT NO. 21227 WHEREAS, by Resolution No. 1529 the City Council of the City of Downey, adopted the 8th day of March, declared its intention to vacate that portion of Farm Street and Myrtle Street as shown on a map on file in the office of the City Clerk, and setting a hearing thereon for the hour of 7:30 P.M. April 12, 1965; and WHEREAS, the public hearing on said intended vacation duly was held and a full and fair hearing was had thereon. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey finds from all the evidence submitted at said hearing that that portion of Farm Street and Myrtle Street as shown in Tract No. 21227, hereinafter described is unnecessary for present or prospective street purposes, and it is hereby ordered vacated. Said area so vacated is described as follows: Parcel No. 1: All that portion of Farm Street, Myrtle Street and public alleys as shown on Tract No. 21227 and recorded in Map Book No. 620, Page 41 in the Office of the County Recorder, County of Los Angeles, State of California. Parcel No. 2. A strip of land 15.00 feet wide, being the southeasterly 15.00 feet of the northwesterly 50.5 feet of the northeasterly 20.40 feet of that certain parcel of land in the Rancho Santa Gertrudes, as shown on map recorded in Book 1, ,.� Page 156 et sdq.of patents, Records of the County of Los Angeles, described in deed to Ralph Lucci, recorded in Book 5580, Page 175 of deeds, Records of said County. Parcel No. 3. A strip of land 2.00 feet wide, being the south- easterly 2.00 feet of the northwesterly 35.5 feet of that certain parcel of land in the Rancho Santa Gertrudes, as shown on map recorded in Book 1, Page 156 et seq. of Patents, records of Los Angeles County, described in deed to Ralph Lucci, recorded in Book 5580, Page 175 of Deeds, Records of said County. To be known as Paramount Boulevard. SECTION 2. Pursuant to the authority of Section 8330 and 8331 of the Streets and Highways Code of the State of California, the City Council hereby determines that the public convenience, and necessity require the reservations of a permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew storm drains, sanitary sewers, and appurtenant structures in, upon, over and across the street or part thereof, proposed to be vacated, and maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures and fixtures for the operation of gas pipe lines, telegraph and telephone lines, and for the transportation and distribution of electrical energy water, and incidental purposes, including access and the right to keep the property free from flammable materials and weed growth, and otherwise protect the same from all hazards in, upon, and over that portion of the street proposed to be vacated and described as follows: Parcel No. 1. Beginning at the most southerly corner of Lot 8 of Tract No. 21227, Map Book 620, Pages 40 and 41; thence along the northwesterly line of Myrtle Street as shown on the map of said tract, North 31 East 449.52 feet to the northeasterly line r X354 of said tract; thence along said northeasterly line South 58 ° 40'42" East 30 feet to the centerline of said Myrtle Street; thence along said centerline South 31 ° 54'51" West 449.29 feet to the southeasterly prolongation of the south- westerly line of said Lot 8; thence along said prolongation North 59 ° 06'50" West 30 feet to the point of beginning. Also reserving to the City of Downey an easement for drainage purposes described as follows: Parcel No. 2. Beginning at the most southerly corner of said Lot 8; thence along the southwesterly line of Tract No. 21227 South 59 ° 06'50" East 30 feet to the true point of beginning; thence North 31 ° 54'51" East 55.00 feet; thence southerly in a direct line to a point in the southeasterly prolongation of said southwesterly line that is South 50 ° 06'50" East 15.00 feet from the true point of beginning; thence North 59 ° 06'50" West along said prolongation a distance of 15.00 feet to the true point of beginning. Also reserving to the City of Downey an easement 10 feet wide for public utility purposes, the southwesterly line of which is described as follows: Parcel No. 3. Beginning at the intersection of the northeasterly prolongation of the northwesterly line of Lots 5, 6 and 7 of Tract No. 21227 with the northwesterly prolongation of the north- easterly line of said Lot 5; thence along said northeasterly line of Lot 5 and its prolongations South 59 ° 19'21" East 174.88 feet to an intersection with the northwesterly prolongation of the northeasterly line of Lot 10 of said tract; thence along said northeasterly line of Lot 10 and its prolongations South 58 ° 40'42" East 181.43 feet to the northeasterly prolongation of the south- easterly line of Lots 8, 9 and 10 of said tract. The northeasterly line of the above described easement is to be prolonged or shortened so as to terminate in the northeasterly prolongation of the northwesterly line of said Lot 5, and in the northeasterly prolongation of the southeasterly line of said Lot 10. All proceedings for the vacation of said street are taken and shall be subject to the reservation of said described easement. SECTION 3. The City Clerk shall certify to the adoption of this resolution and cause a certified copy thereof, attested by the City Clerk under the seal of the City of Downey, to be recorded in the office of the County Recorder of the County of Los Angeles.
