A RESOLUTION OF THE
H CITY COUNCIL OF THE CI TY OF
DOWNEY FINDING AND DETERMINING THAT THE PUBLIC
INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE
ACQUISITION OF CERTAIN PROPERTY FOR PUBLIC USE
FOR STREET AND HIGHWAY PURPOSES
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the City Council hereby finds, determines
and declares that the public interest and necessity require the
acquisition of an easement and right of way in, over, and under the
hereinafter described real property for street and highway purposes.
That the location and alignment for said easement and right
of way has been planned and located in the manner which will be most
compatible to the greatest public good and the least private injury.
SECTION 2. That the City Council hereby finds, determines
and declares that, in order to acquire said easement and right of way
and use the same for said purposes, the public interest, convenience
and necessity require the acquisition of the right of way by the City
of Dc .wry in, over and under that real property hereinafter described
and the City Council hereby declares it is the intention of the City
of Downey to acquire in its name said right of way in, over and under
the hereinafter described real property by condemnation in accordance
with the provisions of the Code of Civil Procedure and the Constitution
of the State of California authorizing the exercise of the right of
eminent domain.
SECTION 3. That said real property, the acquisition of an
easement and right of way in, over and under which is required by the
public interest, convenience and necessity for the purposes set forth
in Sections 1 and 2 hereof, is described on Exhibit "A" attached hereto
and by this reference made a part hereof.
That portion of the land in the City of Downey conveyed by Document
No. 1589 recorded August 16, 1954, in Book 45332, page 8 of Official Records
of the County of Los Angeles, State of California, included within the
following boundaries:
That portion of land within the lines of Bixler Avenue fifty (50) feet
wide and Century Boulevard twenty (20) feet wide, as shown on Map filed as
Document No. 3564 on October 17, 1963, in Book 4, pages 73 and 74 of Official
Maps in the office of the County Recorder of said county.

Downey conveyed by Document No. 1670 recorded August 2, 1961, in Book D -1306,
Page 998, of Official Records of the County of Los Angeles, State of California.

SECTION 4. That the City Attorney of the City of Downey and
Burke, Williams & Sorensen hereby are authorized, empowered, and
directed to prepare, institute and prosecute in the name of the City
of Downey such proceedings in the proper court having jurisdiction
thereof as are necessary for the condemnation of the said easement
and right of way described in said Exhibit "A ".
Said attorneys hereby are authorized and empowered to take

such p rocedure as may be necessary to secure an order of immediate
possession for the use and occupancy of said property, and the
deposit of any money by the City necessary therefor, is hereby
approved and authorized.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
