HomeMy WebLinkAboutResolution No. 1510 2307 RESOLUTION NO./io A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO IMPROVE MARGARET STREET IN THE CITY OF DOWNEY, DETERMIN- ING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREFOR, DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE ASSESSED UPON A DISTRICT (AD -40) WHEREAS, the City Council of the City of Downey pursuant to the provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, being Division 4 of the Streets and Highways Code of the State of California has held a hearing and adopted a resolution declaring the feasibility of the proposed improvement hereinafter described; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY, DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Downey to order the following work to be done, to wit: The acquisition of rights of way for the widening and extension of Margaret Street to a full right of way of 60 feet between Lakewood Boulevard and the easterly termination of proposed Margaret Street in a cul-de-sac approxi- mately 1070 feet easterly of the center line of Lakewood Boulevard and the acquisition of right of way for that certain alley being the first alley a 4steriy of Bellflower Boulevard and extend- ing between the said proposed Margaret Street and Hall Road, said alley right of way being 30 feet in width. To be known as the alley South of Margaret Street and East of Lakewood Boulevard.' • • • • • 2310 The improvement of: (a) Margaret Street, including the existing right of way and right of way to be acquired between Lakewood Boulevard and the easterly termination of Margaret Street being 1060 • feet easterly of the center line of Lakewood Boulevard by clearing, grading, excavation, removal of obstruction, construction of subgrade and asphaltic pavement on aggregate base construction of Portland cement g concrete curbs, gutters, cross - gutters, alley inter- section, sidewalks, driveway aprons, six and eight - inch water mains and all appurtenant work thereto. (b) First alley easterly of Bellflower Boulevard and extending between the proposed Margaret Street and Hall Road, said alley right of way being the right of way above - described 30 feet in width by the clearing, grading, excavation, removal of obstructions, construction of subgrade and asphaltic pavement on concrete base, construction of Portland cement concrete alley gutter, construction of sewer, manholes, laterals and six -inch water main and all appurtenant work thereto. Work is to be done upon that certain private prop- erty commonly known as 9051 to 9055 Iowa Street to eliminate the disparity in level between the improve- ment on said alley and a driveway upon such private property and it is in the public interest and more economical to do such work on private property than to adjust the work on public property to eliminate such disparity. -4- (0) That portion of Lakewood Boulevard between a point 55 ; feet northerly and a point 55 ± feet southerly of the prolongation of the center line of Margaret Street by the clearing, excavation, removal of obstructions, construe- , tion of subgrade and asphaltic pavement on aggregate base, construction of Portland cement, concrete curbs, gutters and cross - gutters and construction of ten -inch water main and all appurtenant work thereto. (d) That portion of Hall Road between a point 25 4 feet easterly and a point 25 * feet westerly of the prolongation of the center line of said proposed alley by the clearing, grading, excavation, removal of obstructions, construction of subgrade and asphaltic pave- ment on aggregate base and alley intersection and all appurtenant work thereto. (e) That portion of Iowa Street between a point 366 t feet easterly and a point 472 i feet easterly of Bellflower Boulevard by the clearing, grading, excavation, removal of obstructions, construction of subgrade and asphaltic pavement on aggregate base, construction of Portland cement, concrete curbs, gutters and construction of sewer and all work appurtenant thereto. -5- it That all of the foregoing work shall be done in accordance with the profile and improvement plan, No. 1- 17 -11, and any supplemental drawings mentioned thereon, which said profile and improvement plan was adopted by Resolution No. of the City Council on January 26, 1965, and is on file in the office of the City Engineer of the City of Downey, and in accordance with specification entitled "Assessment District No. 40 - Margaret Street" which was adopted by Resolution No. of the City Council on January 26, 1965. The work and improvement herein described shall be constructed to the grades, subgrades, and elevations severally shown upon said profile and improvement plan, No. i- 17 -11, and detailed drawings thereon, in the respective locations thereof. Reference hereby is made to the profile and improvement plan, No. 1- 17 -11, for a description of the grades to which all the work and improvements under this Resolution of Intention shall be done, which said grades hereby are adopted and established as the official grades therefor, for all purposes in connection with the proceedings pursuant to this Resolution of Intention. Notice hereby is given that said grades are or may be, in part, new and different from those hereto- fore established or existing, or may be, and in some cases are, different from existing ground levels. SECTION 2. The estimated cost of this improvement is $103,824.99. There shall be contributed to the cost of doing said work the amount for incidentals attendant upon the work done upon dedicated streets and incidentals in relation to the ten -inch water main to be installed, such amount to be contributed to be estimated at $7,165.23. The exact amount to be contributed shall be determined after the work has been completed and prior to the confirmation of the assessment and the contribution by the City of said amount shall be paid out of the treasury of said City and from the General Fund thereof. - 6- 2313 That said proposed work or improvement in the opinion of the City Council of the City of Downey, is of more than local or ordinary public benefit, and the Council hereby proposes that the district in the City of Downey to be benefited by said work or improvement and to be assessed to pay the cost and expenses thereof is shown on that certain plan or map, No. AD -40, indicating the exterior boundary thereof, approved by Resolution No. 1387 of the City Council on June 23, 1964, and on file in the office of the City Engineer. Said plan or map hereby is referred to and shall govern for all details as to the extent of the assessment district. The assessment district includes, in general, the lots and parcels of land abutting upon or contiguous to the hereinabove described streets, but reference hereby is made to said plan or map for all details as to the extent of said assessment district and for any variation between the last mentioned general descrip- tion and the extent of the assessment district as shown on the plan or map. All public streets or alleys, or portions thereof, hereby are excepted from said district. SECTION 3. That serial bonds, bearing interest at the rate of be issued represent each assessment of $50.00 per annum, shall b i sued to 61% p p �5 or more remaining unpaid for thirty days after the mailing of the notice by the contractor as provided in Section 5390 of the Streets and Highways Code. Said serial bonds shall extend over a period endin g nine years from the second day of January next succeeding the next September 1st following their date. Payments on the principal of unpaid assessments and interest shall be made by property owners to the City Treasurer, and the sums shall be disbursed by him or as provided in the Improvement Act of 1911 hereinafter referred to. SECTION 4. Notice hereby is given that on March 8, 1965, at 7:30 p. m. in the Council Chamber of said City in the City Hall located at 8425 Second Street, Downey, California, any and all 7_ 2'31- persons having any objection to the proposed work or improve - ment, to the extent of the assessment district, or both, may appear before the City Council and show cause why the proposed work or improvement should not be carried out in accordance with this Resolution of Intention. Protests must be in writing, must contain a description of the property sufficient to identify it, and must be delivered to the City Clerk not later than the hour set for hearing. SECTION 5. The Superintendent of Streets immediately shall cause notice of the passage of this Resolution of Intention to be posted conspicuously along the line of the contemplated work or improvement and along all the open streets within said district, in the manner and form prescribed by law. The City Clerk hereby is directed to mail notices, in the manner and form prescribed by law, of the adoption of this resolution to all persons owning real property in the hereinbefore described assessment district, whose names and addresses appear on the last equalized assessment roll for City taxes or as known to the City Clerk. SECTION 6. The City Council of the City of Downey, in making the improvement and in doing the work prescribed herein, elects to P g P proceed under and in accordance with the provisions of the Improve- ment Act of 1911, being Division 7 of the Streets and Highways Code of the State of California. SECTION 7. The City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published twice in the "Southeast News and Champion," a newspaper published and circulated in the City of Downey, the first of which publications shall be not less than ten (10) days prior to March 8, 1965, the date of said hearing, and which hearing shall be not less than fifteen (15), nor more than sixty (60) days after the date of adoption of this resolution. _8- 2 31 SECTION 8.
