A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY URGING THE STATE LEGISLATURE TO ENACT LEGISLATION RESTOR- ING THE RIGHT TO CITIES TO REGULATE PROBLEMS OF LOCAL CONCERN WHEREAS, historically the strength of California cities and the strength of the state government has depended, in part, upon the right of cities to exercise home rule; and WHEREAS, good local government has developed through the process of "local laws for local problems;" and WHEREAS, it is essential for the proper administration of government throughout this state that local governing agencies be permitted to enact laws necessary to control problems of a local nature; and WHEREAS, by recent decisions of the courts of this state the right of local governmental agencies to act upon their local problems by local problems by local laws has been diminished; and WHEREAS, it is necessary that some expression of intention be set forth by the legislature of the State of California as to the extent of the applica- tion of certain general laws affecting matters heretofore believed to be of local concern and subject to local regulation; and WHEREAS, in the absence of such expression of intention by the legislature it is feared that the erosion by judicial decision will increase, thus destroy- ing the historic keystone of local government in this state, that is, the doctrine of home rule; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the legislature of the State of California hereby is urged to enact a statute which will authorize local governmental agencies to enact legislation concerning local subjects even though the legislature may have spoken to some degree concerning the entire field and that there be an express provision that unless the state legislature specifically states it has preempted a particular field of law or regulation that no such preemption has occurred. SECTION 2. The City Clerk shall certify to the adoption of this resolu- tion and cause certified copies thereof to be forwarded to such representatives in the state legislature as may be appropriate and to appropriate committees and governmental agencies.
