J Co `r A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING RESOLUTION NO . 1390 CONCERNING THE WATER RATES AND RULES FOR SERVICE OF WATER BY THE CITY WHEREAS, Resolution No. 1390 was adopted by the City Council of the City of Downey on the 23rd day of June, 1964; and WHEREAS, it has been found that certain provisions of said Resolution No. 1390 should be revised in order to provide more equitable charges for service; NOW, THEREFORE, BEFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. Section 1 of Resolution No. 1990 shall be amended by deleting the following sentence: "For each business over one, using the same meter, add $3.00 to minimum ". SECTION 2. Section 7 of said Resolution No. 1390 shall be amended to read as follows: "Section 7. Water for construction and miscellaneous uses shall normally be furnished through a temporary service connection. Applicant shall designate the period of time and purpose for which water is to be used. The Water Division may discontinue the supply and remove its equipment at the expiration of the period so designated. Water Supply is subject to limitations as to rate of flow and time of use. "Water Division will initially install all equipment necessary to furnish a temporary water supply and upon payment of the charges pro- vided herein, will move equipment for any subsequent changes in location, as requested by applicant, except when the applicant is being furnished water on a flat rate basis, and is supplying his own eddy valve. "At time of application for service, applicants who are requesting City equipment to be installed, shall make a deposit of $100.00 as security against loss or damage to equipment, and to secure payment of Division charges, for furnishing, installation, removal, inspection, and rental of equipment used. "If applicant requires more than one temporary service connection, requiring City equipment during the time his deposit is in effect, only " that sum of money necessary to make up any reduction in his original $100 deposit will be required. In case of non - return of City equipment, or damage beyond repair, applicant shall pay a charge of $250 for replace- ment of water meter and $50 for replacement of eddy valve. "In addition to the regular domestic rate for water usage, as specified in Section 1 of Resolution No. 1390, or a minimum charge of $15.00 for each month, applicant for temporary service from a fire hydrant shall pay the following charges: 1. A charge of $15.00 for the first installation on each job •—. or project, and $5.00 for all subsequent installations on the same job or project, to cover service charges, and the cost of installing and removing equipment to furnish and measure the temporary water supply. 2246 2. Any charges incurred by the Water Division for repairing equipment furnished by the Water Division, if such equip - ment is damaged through carelessness, negligence, or abuse by the applicant. Such charges, as outlined above, may be deducted from the deposit. "Where it is impractical to furnish such water through a temporary metered connection, the quantity of water shall be estimated and shall be charged for at the rate of 30 per 100 cubic feet. Minimum charge shall be $15.00 per month. "Service shall be thsed on the use of 100 cubic feet of water for each of the following construction units or any portion thereof: a. 1,000 brick laid (one square foot of surface of a 4" Thick wall requires 6 bricks). b. For settling filled ground or flooding backfill - for each 300 cubic feet of fill. c. For settling each 400 square feet of fine grade. "For miscellaneous uses where water is drawn from hydrants into portable tanks, the charge shall be at the rate of $1.00 per 1,000 gallons or fractions thereof. "If service is to be metered, a meter and eddy valve shall be furnished and installed by the City, in accordance with the provisions herein. If service is to be on a flat rate basis, an eddy valve shall be used at all times. It shall be at the option of the applicant whether his own or the City's is used. In all cases, applicant shall control fire hydrant flow by means of the eddy valve only, and shall not operate the main fire hydrant valve except in an emergency. Unauthorized use of fire hydrants for any purpose is a violation of the Downey Municipal Code and violators will be prosecuted under the provisions of this Code." SECTION 3.
