RESOLUTION NO.%
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY URGING THE STATE LEGISLATURE TO ADOPT
LEGISLATION CLEARLY AUTHORIZING LOCAL CONTROL OF
GAMBLING
WHEREAS, by judicial determination it appears that in adopting
•^ Penal Code Section 330 the State has preempted the field in regard to
the regulation of certain card gambling games, thus vitiating local
legislation in the field; and
WHEREAS, State legislation is inadequate to control gambling in
areas of large concentrations of population; and
WHEREAS, the State Legislature has heretofore recognized this
inadequacy by virtue of Penal Code Section 337s(e) insofar as State
legislation applies to draw poker, including low -ball poker, which
subsection is quoted in part as follows:
(e) The Legislature finds that in counties with a large,
concentrated population, problems incident to the playing
of draw poker are, in part, qualitatively, as well as
quantitatively, different from the problems in smaller
counties."
and
WHEREAS, there has been a sudden influx in Los Angeles County of
card gambling games not mentioned by Penal Code Section 330, and
particularly the game of panguingui; and
WHEREAS, said card gambling games not proscribed by Penal Code
Section 330, and particularly the game of panguingui, have caused a
substantial police problem in several cities in Los Angeles County,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. That the City Council of the City of Downey does hereby
respectfully urge the Honorable Jesse M. Unruh, Speaker of the Assembly
of the State of California, to immediately establish a Legislative
Committee for the purpose of drafting proposed legislation for introduction
at the next session of the Legislature, said bill to amend Section 330 of
the Penal Code of the State of California to clearly provide that the State
has not preempted the field with respect to gambling, and that municipalities
may adopt supplementary legislation to maintain effective local control.
SECTION 2. That the City of Downey does hereby request the aid of
the League of California Cities in averting this serious threat to the con-
cept of "home rule" government in the State of California, and strongly
recommends that all other municipalities in the State adopt similar resolu-
tions urging the adoption of corrective legislation.
SECTION 3. That the City Clerk is hereby directed to forward a
certified copy of this Resolution to the Honorable Jesse M. Unruh, Speaker
of the Assembly of the State of California, Subway Terminal Building,
Room 432, Los Angeles, California.
SECTION 4. The City Clerk shall certify to the adoption of this reso-
