A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DOWNEY DESIGNATING A REDEVELOPMENT
SURVEY AREA FOR STUDY PURPOSES, FOR AMENDMENT NO. 5C
AND DIRECTING THE PLANNING COMMISSION TO SELECT THE PROJECT
BOUNDARIES AND TO FORMULATE A PRELIMINARY PLAN
(LAKEWOOD AND GALLATIN)
WHEREAS, the City Council of the City of Downey, California,
has adopted an ordinance finding the need for a redevelopment
agency to function in the City Downey; and
WHEREAS, the Community Development Commission has been duly
organized as the Redevelopment Agency of the City of Downey, with
this Council siting as the Community Development Commission; and
WHEREAS, the Downey Redevelopment Plan was adopted on August
8, 1978 by Ordinance No. 553; Amendment No. One was adopted on
August 14, 1979 by Ordinance No. 603; Amendment No. Two was
adopted on October 28, 1980 by Ordinance No. 633 and Amendment No.
Four was adopted on July 20, 1987 by Ordinance No. 856; and
WHEREAS, in accordance with Section 33310 of the California
Health and Safety Code, this Council, as the legislative body, may
designate a redevelopment survey area for study purposes; and
WHEREAS, in accordance with Section 33311 of the California
Health and Safety Code, any person, group, association or
corporation may be in writing, request that the legislative body
designate a survey area for study purposes, and
WHEREAS, the City of Downey has received a request from
Downey Ford to consider placing their properties in the survey
area; and
WHEREAS, in accordance with Section 33312(b) of the
California Health and Safety Code, the redevelopment survey area
for Amendment No. 5C is attached and a part of this Resolution as
Exhibit "A ";
WHEREAS, the area contained in Exhibit "A" requires study to
determine if an amendment is necessary to the existing
Redevelopment Plan; and
WHEREAS, in accordance with Section 33322 3 22 of the California
Health and Safety Code, the Planning Commission of the City of
Downey shall, at the direction of the City Council, select a
project area from within the boundaries of the survey area and
formulate a preliminary plan for the area so selected.

NOW, THEREFORE, the City Council of the City of Downey HEREBY
RESOLVES as follows:
Section 1. Pursuant to Section 33312(a) of the California Health
and Safety Code, the City Council HEREBY FINDS that the area shown
in Exhibit "A" requires study to determine if a redevelopment
project within the area is feasible.
Section 2. Pursuant to Section 33312(b) of the California
Health and Safety Code the City Council HEREBY DESIGNATES the
boundaries of the Survey Area of Amendment No. 5C as contained in
Exhibit "A ", attached to and a part of this Resolution.
Section 3. The City Council HEREBY DIRECTS the Planning
Commission, in cooperation with the Community Development
Commission, to select a redevelopment project area from within the
boundaries of the survey area in accordance with Sections 33322
and 33323 of the California Health and Safety Code.
Section 4. The City Council HEREBY DIRECTS the Planning
Commission to formulate a preliminary plan for the redevelopment
project area in accordance with Section 33324 of the California
Health and Safety Code for submittal to the Downey Community
Development Commission.
Section 5. If any section, subsection, sentence, clause,
phrase or word of this Resolution is for any reason held to be
invalid by a court of competent jurisdiction, such decisions shall
not effect the validity of the remaining portions of this
Resolution. The City Council HEREBY DECLARES that it would have
passed and adopted this Resolution irrespective of the fact that
any one or more of said provisions may be declared to be invalid.
