RESOLUTION NO. / 94 p
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY RESERVING FRINGE BENEFITS TO CAREER EMPLOYEES
WHEREAS, the Downey Merit System exists to promote a career city
service; and
WHEREAS, inconsistencies exist as to whether non - career employees
are eligible for vacation, holiday and sick leave benefits.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. That Part II, Section 6 of that certain document enti-
tled "Downey Personnel Manual" be and the same is hereby amended, by
changing the last sentence of the Section to read, "all employees who
do not hold regular probationary or permanent appointments shall be com-
pensated at an hourly wage rate and shall be subject to all provisions of
those rules."
SECTION 2. That Procedure VI, Section 5 of that same Manual be and
the same is hereby amended to read:
(a) Municipal offices shall be closed on the following days which
have been designated as legal holidays for all probationary
and erman nt
p e employees in the city service: New Year's Day
(January 1st); Lincoln's Birthday (February 12); Washington's
Birthday (February 22)'; Memorial Day (May 30); Independence
Day (July 4); Labor Day (1st Monday in September); Veteran's
Day (November 11); Thanksgiving Day (Last Thursday in Novem-
ber); Christmas Day (December 25); and State -wide election
days in accordance with the provisions of the State Election
Code. When a holiday falls on Sunday, the following Monday
shall be observed. When a holiday falls on Saturday, the pre-
ceding Friday shall be observed.
(b) All employees, probationary and permanent, other than police
and fire personnel, required to work on authorized holidays
may be compensated at the rate of one day's additional salary
for each additional day of service or given compensatory time
off, as determined by the department head and approved by the
City Manager.
SECTION 3. That Procedure VI, Section 7 (b2) of that same manual be
and the same is hereby amended as follows:
(b) Restrictions: All employees in the classified service shall
be entitled to annual vacation with pay except the following:
1. All employees who have served less than six moraths' service;
however, vacation credits for the time shall be granted to
each such employee who later receives a permanent appoint -
ment.
2. All hourly employees.
SECTION 4. That Procedure VI of that same manual be and the same is
hereby amended by adding a new Section 13 thereto to read as follows:
Section 13: Unclassified Employees: All provision to the contrary
notwithstanding all full time employees covered by
Section 2704, subsections e, f and g of the Municipal
Code shall be entitled to all benefits and provisions of
Procedure VI, Attendance and Leaves of that certain
document entitled Downey City Personnel Manual.

I!I SECTION 5. The City Clerk shall certify to the adoption of this
resolution.
