HomeMy WebLinkAboutResolution No. 1331 2035 RESOLUTION NO. 1331 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT ASSESSMENT DISTRICT NO. 17, RUTGERS AVENUE, IS FEASIBLE AND THAT THE LANDS WITHIN THE PROPOSED DISTRICT WILL �-• BE ABLE TO BEAR THE BURDEN OF SUCH PROPOSED ASSESSMENT WHEREAS, by Resolution No. 1303 of the City Council of the City of Downey, a public hearing was set for February 10, 1964, at 8:00 o'clock Y P g Y P.M. upon the Investigation Report of the City Engineer of the City of Downey, pertaining to the proposed Assessment District No. 17 (Rutgers Avenue) to hear all protests and objections to the said report and the doing of work proposed thereunder; and II 'I WHEREAS, on February 10, 1964, at 8:00 o'clock P.M., the said public hearing was duly and legally held at which time the report was first read in full; and WHEREAS, protests having been filed by the owners of the property proposed to be assessed for said improvement and having been heard and overruled by the City Council. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Downey does hereby find that the proposed project being entitled "Assessment District No. 17 (Rutgers Avenue) is feasible and that the public interest, convenience and necessity require the proposed work and improvement and that the lands to be assessed will be able to carry the burden of the proposed assessments and the limitations upon the amount of assessments provided for in the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931," being Division 4 of the Streets and Highways Code of the State of California, shall be disregarded both with respect to the limitation on the district as a whole and as to the limitations on the individual specific assessments. SECTION 2. The proceedings for the said improvement shall be taken under the Improvement Act of 1911, being Division 7 of the Streets and Highways Code of the State of California, and improvement bonds shall be issued pursuant to the provisions of this said improvement act. SECTION 4. The City Clerk is directed to endorse upon the said Investigation Report the approval thereof by the City Council. SECTION 4. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect. APPROVED AND ADOPTED this 10th day of tebruary, 1964.
