RESOLUTION NO. 47W
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DOWNEY FINDING AND DETERMINING
THAT ZONE CASE CHANGE NO. 98 SHOULD BE
DENIED
WHEREAS, an application for a change of zone was filed
and designated Zone Change Case No. 98 of the City of Downey;
and
WHEREAS, said application requested the change of zone
on the property described therein from R -1 to R -3; and
WHEREAS, after a hearing duly held thereon, the Planning
Commission denied said request and thereafter an appeal from
the action of the Planning Commission was taken to the City
Council; and
WHEREAS, the Director of Planning transmitted to the City
Council a copy of all pertinent information contained in the
Commission's permanent file relating to said Zone Change Case
No. 98; and
WHEREAS, the City Council held a public hearing on said
Zone Change Case No. 98 on January 13, 1964, and evidence both
for and against said zone change was heard;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY
DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council finds:
(a) That the property described in Zone Change
Case No. 98 properly is zoned R -1 and the conditions affecting
such property have not changed materially since said property
was so zoned and thus no change of zoning thereon is justified.
(b) The change of zone from R -1 to R -3 would
affect adversely adjoining property, as such property is
developed primarily for less dense residential uses than would
be permitted under zone R -3 and the use of the subject property
for R -3 uses would not be compatible with the use being made of
adjacent property.

(c) That the general layout and development
of the property within the area, the street pattern within
the area and the public utilities and facilities available
therefor generally speaking are more suitable for the use of
the subject property as R -1 rather than R -3.
(d) That change of zone to R -3 would not be
in the interest or furtherance of the public health and
safety and general welfare and would be contrary to the public
health, safety, and general welfare.
(e) The approval of such change of zone would
affect adversely the comprehensive zoning plan prepared for the
City of Downey and would not be in conformity with the develop-
ment of said area as proposed on said plan.
(f) That the members of the City Council have
viewed the premises and the surrounding territory; and based
upon such view and the evidence presented at the public hearing,
find that the rezoning of said property from R -1 to R -3 would
be inconsistent with, and contrary to, the general purpose and
plan of Chapter 1 of Article IX of the Downey Municipal Code.
SECTION 2. The appeal in Zone Change Case No. 98 is
denied, the action of the Planning Commission in denying said
zone change is affirmed and it hereby is determined that no
change of zone shall be made on said subject property from R -1
to R -3.
SECTION 3. The City Clerk shall certify to the adoption
of this resolution, and thenceforth and thereafter the same
shall be in full force and effect.
