HomeMy WebLinkAboutResolution No. 1309 RESOLUTION NO. 1309 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING CERTAIN LIGHTING FIXTURES, APPURTENANCES AND APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES OF SAID CITY TO BE MAINTAINED AND ELECTRIC CURRENT TO BE FURNISHED ALL IN ACCORDANCE WITH RESOLUTION NUMBER 1292 OF SAID CITY (DOWNEY CITY LIGHTING DISTRICT, ANNEXATION A, ZONE 1) WHEREAS, the City Council of the City of Downey on December 24, 1963, adopted Resolution Number 1292 ordering the Director of Public Works to prepare Plans, Specifications, Estimate and Report pursuant to the provisions of Division 14, Part 1, Streets and Highways Code of the State of California; and WHEREAS, on December 24, 1963, in compliance with the order of the City Council as set forth in said Resolution Number 1292, the Director of Public Works did file with the City Clerk the Plans, Specifications, Estimate and Report in writing; and WHEREAS, on December 24, 1963, said matter so filed was submitted to the City Council and the City Council approved said report and adopted Resolution Number 1293 declaring its intention to order these certain improvements as aforesaid; and WHEREAS, on December 24, 1963, the City Council by Resolution Number 1294 appointed the hour of 7:30 o'clock P.M. on January 13, 1964, as the time, and place for hearing protests in relation to said pro- ' posed improvement as the Council Chamber in the City Hall at 8425 E. Second St.; and WHEREAS, on January 13, 1964, at the time and place as specified, r" a public hearing duly was held in relation to said improvement, all in accordance with said Resolution Number 1294, notice having duly given of said hearing in the manner required by law; and WHEREAS, at said hearing the City Council did hear and pass upon all written and oral protests made with reference to said improvement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. Boundaries of the Downey City Lighting District, Annexation A, Zone 1 are described as shown on the document attached hereto, designated as "Exhibit A ", and by this reference incorporated herein and made a part hereof, and the same as though set forth in full. The District shall be divided into Zones which shall be designated as described on Exhibit "A" and established with the Boundaries as described on Exhibit "A", and by this reference made a part hereof the same as though set forth in full. SECTION 2. The District shall be named, designated and known as "Downey City Lighting District, Annexation A, Zone lY SECTION 3. The ro osed improvement shall be for a period of time P P P beginning from the formation of the District and ending January 31, 1983. r-� SECTION 4. The proposed improvement consists of the maintenance and furnishing of energy for street lighting throughout the District as described and all in accordance with the Plans, Specifications and Report of the Director of Public Works, as approved by the City Council. PP Y Y 1 _ J SECTION 5. The estimated cost of said improvement for the first year is: $874.39 SECTION 6. The entire estimated cost of said improvement for the first year shall be borne by the District. The portion of the esti- mated costs for the first year borne by each Zone is as follows: $874.39 SECTION 7. It is hereby ordered that the portion of the estimated cost proposed to be borne by the District shall be paid by special assessment taxes levied upon all the lands and improvements within the District and any zone therein. SECTION 8. It is hereby ordered that said proposed improvements as described and set forth in Resolution Number 1293 and in the Report of the Director of Public Works made pursuant to Resolution Number 1292 be made in a manner and at the same time as prescribed by law. SECTION 9. The City Council hereby finds that the Southern Calif- ornia Edison Company is the only contractor practically capable of serving the street lighting system to be improved in the manner provided for as described herein, and the Southern California Edison Company is subject to the jurisdiction of the Public Utilities Commission of the State of California. It is hereby ordered that the improvement of said lighting District be carried out in accordance with the Plans and Specifications by Southern California Edison Company. SECTION 10. It further is ordered that the Mayor hereby is author- ized and directed to execute the contract with the Southern California Edison P Company for the improvement in accordance with said Plans and P Y Specifications, and in accordance with rates and rules filed by said Company from time to time with the Public Utilities Commission of the State of California. SECTION 11. The City Clerk shall certify to the adoption of this Resolution and cause a certified copy thereof and a map or plan of the PY P P District to be filed with the Assessor whose roll is used for levying and with the State Board of Equalization and further shall cause copies of this Resolution to be published once in the "Downey Live Wire." APPROVED AND ADOPTED this 13 day of January , 1964.
