HomeMy WebLinkAboutResolution No. 1136 1746 RESOLUTION NO. , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY OPPOSING THE UNWARRANTED LIBERALIZATION OF WORKMAN'S COMPENSATION BENEFITS -- WHEREAS, Assembly Bill 424 as introduced provides that where certain injuries or disabilities are sustained by employees after specified periods of service, these injuries or disabilities are conclusively presumed to be covered by Workman's Compensation Insur- ance; and WHEREAS, it is believed that this measure is unconstitutional due to its requirement of the payment of Workman's Compenattion Benefits even where it may be proved that such injuries were not the result of the employment of an individual, which is in distinct violation of the constitutional limitations on Workman's Compensation Insurance; and WHEREAS, this measure would tend to establish a trent of mandatory payments in Workman's Compensation which could not otherwise be allowed under the constitutional philosophy of the system. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That it expresses its opposition to Assembly Bill 424 and all similar legislation which would unjustly alter the Workman's Compensation system in the State of California to a system of mandatory benefits. SECTION 2. The City Clerk shall certify to the adoption of this resolution and cause copies to be forwarded to State representatives at Sacramento for this City.
