A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY OPPOSING ASSEMBLY BILL #856 RELATIVE TO POLITICAL ACTIVITIES OF PUBLIC EMPLOYEES WHEREAS, Assembly Bill #856 as introduced by Petris (Elections and Reapportionment) repeals and adds various sections to the Government Code; and WHEREAS, Assembly Bill #856 repeals present provisions proscribing political activities of county and city employees; and WHEREAS, Assembly Bill #856 provides that no local agency shall limit participation of its employees in political activities during their off -duty hours, but authorizes agency to adopt ordinance prohibiting officers or employees from receiving or soliciting political contributions from other personnel of agency; prohibiting nominees or candidates for offices of agency from promising employment benefits to officers or employees of agency; or prohibiting officers or employees of agency from taking active part in campaign for or against candidate for office or agency; and WHEREAS, Assembly Bill #856 exempts school district employees from provisions of act; and WHEREAS, Assembly Bill #856 declares provisions of act constitute matter of statewide concern, and thus pre -empt field on subject of act; and WHEREAS, the League of California Cities is opposing this bill. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Downey shall oppose Assembly Bill #856 relative to political activities of public employees. SECTION 2. The City Clerk shall certify to the adoption of this resolution and copies shall be forwarded to legislative representatives of this area. APPROVED AND ADOPTED this i f 7"day of , 1963.
