RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CON-
VENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN
PROPERTY FOR STREET PURPOSES, AND RESCINDING RESOLUTION
-- NO. 1089 (DOWNEY AVENUE)
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council hereby finds, determines and
declares that the public interest and necessity require the acquisition
of rights of way in, over and under the hereinafter described real
property for public street purposes and all uses appurtenant thereto.
That the location of the land for said street has been planned and
located in the manner which will be most compatible to the greatest
public good and the least private injury.
SECTION 2. That the City Council finds, determines and declares
that in order to acquire said rights of way in, on, over and under said
land for said street purposes and use the same for said purposes, the
public interest, convenience and necessity require the acquisition of the
rights of way by the City of Downey in, on, over and under that certain
real property hereinafter described, and the City Council hereby
declares it is the intention of the City of Downey to acquire in its name
said rights of way, in, on, over and under said hereinafter described real
property by condemnation in accordance with the provisions of the Code of
Civil Procedure and the Constitution of the State of California authorizing
the exercise of the right of eminent domain.
SECTION 3. That said real property, the acquisition of which is re-
quired by the public interest, convenience and necessity for the purpose
set forth in Section 1 and 2 hereof, is described as follows:
Description 1 - The Southeasterly 18.00 feet of the following
described property:
That portion of Lot 1, Block "C" of Tract No. 212, in the City of
Downey, County of Los Angeles, State of California, as per map re-
corded in Book 14, Page 54 of Maps, in the office of the County
Recorder of said county, described as follows:
Beginning at the most southerly corner of said lot; thence along
the southeast line of the lot, North 34 ° 58'10" East 78.00 feet;
thence parallel with the southwesterly line of said lot, North
58 ° 53'00" West 155.00 feet; thence parallel with the southeast-
erly line of said lot, South 34 ° 58'10" West 78.00 feet to the south
westerly line of said lot; thence along said southwesterly line,
South 58 ° 53'00" East 155.00 feet to the point of beginning.
Description 2 - The Southeasterly 18.00 feet of the following
described property:
The northeasterly 93.00 feet of the southeasterly 155.00 feet meas-
ured along the northeasterly and southwesterly lines thereof of that
portion of Lot 4 in Block "B" of Tract No. 212 in the City of Downey,
County of Los Angeles, State of California, as per map recorded in
Book 14, Pages 54 and 55 of Maps, in the office of the County Record-
er of said county, lying southwesterly of a line extending north-
westerly from a point in the southeasterly line of said lot, distant
northeasterly 165.47 feet from the most southerly corner of said lot
to a point in the northwesterly line of said lot, distant northeast-
erly 162.10 feet from the most westerly corner of said lot.

Description 3 - The Southeasterly 18.00 feet of the fdlowing de-
scribed property:
The southwesterly 120.00 feet, measured along the southeasterly line
thereof of that portion of Lot 1 in Block "C" of Tract No. 212, in
the City of Downey, County of Los Angeles, State of California, as
per map recorded in Book 14 Pages 54 and 55 of Maps, in the office
of the county recorder of said county, lying northeasterly of the
northeasterly line of land described in deed to Hilton L. Gifford
and Cecil Gifford, recorded in Book 14866 Page 138, Official Records.
EXCEPT therefrom that portion of said land described as follows:
Beginning at a point in the southwesterly line of Tract No. 16570
recorded in Book 468 pages 23 and 24 of Maps, in the office of the
County Recorder of said county, distant South 59 ° 09'00" East 60.50
feet from the most westerly corner of Lot 5 of Tract No. 16570;
thence South 34 ° 22'50" West 119.96 feet to the northeasterly line of
the land described in the deed to Milton L. Gifford and Cecil Gifford,
recorded in Book 14866 Page 138 Official Records of said county;
thence along said line North 59 09'00" West 218.00 feet to the north-
westerly line of aforementioned Lot 1, Block "C" Tract No. 212; thence
along said northwesterly line North 30 ° 18'45" East 119.74 feet to the
most westerly corner of aforementioned Tract No. 16570; thence along
the southwesterly line of said tract, South 59 ° 09'00" East 226.51 feet
to the point of beginning.
Description 4 - The Northwesterly 20.00 feet of the following described
property:
The northwesterly 172.49 feet of that portion of Lot 2 in Block "D"
of Tract No. 212, in the City of Downey, County of Los Angeles, State
of California, as per map recorded in Book 14, pages 54 and 55 of Maps,
in the office of the County Recorder of said county, described in the
deed to Andrew M. Benthin, and wife, recorded November 13, 1947 in
Book 25425 Page 116, Official Records in the office of the County
Recorder of said county.
EXCEPTING therefrom the southwesterly 55.45 feet.
ALSO EXCEPTING therefrom that portion lying northeasterly of the fol-
lowing described line:
Beginning at the intersection of the southwesterly line of the north-
easterly 8.50 feet of the land described in said deed to Benthin with
the southeasterly line of the northwesterly 172.49 feet of the land
described in said deed to Benthin; thence northwesterly, along said
southwesterly line, to a point distant southeasterly thereon 75.00
feet from the northwesterly line of said Lot 2; thence northwesterly
in a direct line to a point in the northwesterly line of said Lot 2,
distant southwesterly 11.00 feet from the most northerly corner of
the land described in said deed to Benthin.
Description 5 - The Northwesterly 20.00 feet of the following described land:
That portion of Lot 1 in Block "D" of Tract 212, in the City of Downey,
_. County of Los Angeles, State of California, as per map recorded in Book
14, Pages 54 and 55 of Maps, in the office of the County Recorder of
said county, described as follows:
Beginning at a point in the northwesterly line of said Lot 1, that is
distant thereon South 34 ° 58'30" West 433.60 feet from the most
northerly corner of said lot; thence South 57 ° 55'53" East 337.13 feet
to a point in the southeasterly line of said Lot 1 that is distant
thereon South 35 °56'00" West 416.24 feet from the most easterly corner

of said Lot 1; thence along said southeasterly line, South 35 ° 56'00"
West 95.50 feet to a point in the northeasterly line of the south-
westerly 84.00 feet (measured at right angles) of said Lot 1; said
last mentioned point being North 35 56'00" East 84.28 feet from the
most southerly corner of said Lot 1; thence parallel with the south-
westerly line of said Lot 1, northwesterly 335.80 feet to a point
in the northwesterly line of said Lot 1; thence along said north-
westerly line North 34 58'30" East 100.00 feet to the point of
beginning.
EXCEPT the southwesterly 12.00 feet thereof.
Description 6 - The Southeasterly 18.00 feet of the following de-
scribed property:
The southeasterly 155.00 feet, measured along the northeasterly and
southwesterly lines of that portion of Lot 4 in Block "B" of Tract
No. 212, in the City of Downey, County of Los Angeles, State of Calif-
ornia, as per map recorded in Book 14, Pages 54 and 55 of Maps, in
the office of the county recorder of said county, lying southwesterly
of a line extending northwesterly from a point in the southeasterly
line of said lot, distant northeasterly 165.47 feet from the most
southerly corner of said lot to a point in the northwesterly line of
said lot, distant northeasterly 162.1 feet from the most westerly
corner of said lot.
EXCEPT the northeasterly 93.00 feet thereof.
Description 7 - The Southeasterly 18.00 feet of the following de-
scribed property:
That portion of Lot 1 in Block "C" of Tract No. 212 of the County of
Los Angeles, State of California, as per map recorded in Book 14,
Page 54 of Maps, in the office of the county recorder of said county,
described as follows:
Pcl. 1 - Beginning at a point in the southeasterly line of said lot
distant northeasterly 88.02 feet from the most southerly corner
thereof; thence parallel with the southwesterly line of said Lot North
58 ° 56'00" West 202.31 feet; thence North 31 ° 07'00" East 78.53 feet to
the northeasterly line of the land described in deed to Milton L.
Gifford and wife, recorded April 2, 1937 as Instrument No. 971 in
Book 14866, Page 138, Official Records; thence southeasterly along said
northeasterly line South 58 ° 56'00" East 207.59 feet to the southeast-
erly line of said lot; thence along said southeasterly line South
34 ° 58'30" West 78.71 feet to the point of beginning.
Description 8 - The Southeasterly 18.00 feet of the following de-
scribed land:
The northeasterly 80.00 feet of the southwesterly 183.00 feet, dis-
tances measured parallel with the southeasterly line of the of
the southeasterly 155.00 feet of Lot 3, in Block "B" of Tract No. 212,
in the City of Downey, County of Los Angeles, State of California, as
per map recorded in Book 14, Pages 54 and 55 of Maps, in the office
of the County Recorder of said county.
Description 9 - The Southeasterly 18.00 feet of the following described
property:
The southeasterly 155.00 feet, measured along the northeasterly and
southwesterly lines of that portion of Lot 4 in Block "B" of Tract
No. 212, in the City of Downey, County of Los Angeles, State of

California, as per map recorded in Book 14, Pages 54 and 55
of Maps, in the office of the county recorder of said county,
lying northeasterly of a line extending northwesterly from a
point in the southeasterly line of said lot, distant northeast-
erly 165.47 feet from the most southerly corner of said lot,
to a point in the northwesterly line of said lot, distant north-
- easterly 162.1 feet from the most westerly corner of said lot.
EXCEPT therefrom the southwesterly 91.67 feet, measured along
the southeasterly and northwesterly lines of said southeasterly
155.00 feet.
Description 10 - The Northwesterly 20.00 feet of the following
described property:
That portion of Lot 1 in Block "Dt' of Tract No. 212, in the City
of Downey, County of Los Angeles, State of California, as per
map recorded in Book 14, Pages 54 and 55 of Maps, in the office
of the County Recorder of said county, described as follows:

Beginning at a point in the northwesterly line of said Lot 1,
distant southwesterly 119.60 feet from the most northerly corner
of said lot; thence southeasterly 170.00 feet along a line that
intersects the southeasterly line of said lot at a point distant
southwesterly thereon, 102.25 feet from the most easterly corner
of said Lot 1; thence northeasterly parallel with said northwest-
erly line of Lot 1, 55.00 feet to a line that intersects said
northwesterly line of Lot 1 at a point northeasterly thereon 55.00
feet from the point of beginning; thence northwesterly along said
line, 170.00 feet to said northwesterly line of Lot 1; thence
southwesterly along said northwesterly line of Lot 1, 55.00 feet
to the point of beginning.
SECTION 4. That the City Attorney of the City of Downey, and Burke,
Williams and Sorensen, hereby are authorized, empowered and directed to
prepare, institute and prosecute in the name of the City of Downey, such
proceedings in the proper court having jurisdiction thereof as are nec-
essary for the condemnation of said rights of way in said real property
described in Section 3 of this resolution.
Said attorneys hereby are authorized and empowered to take such
procedure as may be necessary to secure an order of immediate pas session
for the use and occupancy of said property.
SECTION 5. The City Clerk shall certify to the adoption of this
resolution.
