RESOLUTION NO. /G 4
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF DOWNEY FINDING AND DETERMINING THAT THE
PUBLIC INTEREST, CONVENIENCE, AND NECESSITY
REQUIRE THE ACQUISITION OF CERTAIN PROPERTY
FOR STREET PURPOSES (FIFTH STREET)
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the City Council hereby finds, determines,
and declares that the public interest and necessity require the
acquisition of rights of way in, on, over, under, and along the
hereinafter described real property for public street purposes
and all uses appurtenant thereto.
That the location of the land for said street has been
planned and located in the manner which will be most compatible
to the greatest public good and the least private injury.
SECTION 2. That the City Council finds, determines, and
declares that in order to acquire said rights of way in, on,
over, under, and along said land for said street purposes and
use the same for said purposes, the public interest, convenience
and necessity require the acquisition of the rights of way by the
City of Downey in, on, over, under, and along that certain real
property hereinafter described and the City Council hereby
declares it is the intention of the City of Downey to acquire in
its name said rights of way in, on, over, under, and along said
hereinafter described real property by condemnation in accordance
with the provisions of the Code of Civil Procedure and the
Constitution of the State of California authorizing the exercise
of the right of eminent domain.
SECTION 3. That said real property, the acquisition of
which is required by the public interest, convenience, and
necessity for the purposes set forth in Sections 1 and 2 hereof
is described as follows:

PARCEL 1
That portion of the Tract of the Downey Land Association
in the City of Downey, County of Los Angeles, State of California,
as per map recorded in Book 2, Page 434 of Miscellaneous Records,
in the office of the County Recorder of said County, described as
follows
Beginning a8 a point on the centerline of Fifth Street,
distant South 58 17' 40" East 95.02 feet from a 3/4 inch pipe set
in cement at the intersection of said centerline with the center-
line of LaReina Avenue (formerly Depot Street) as shown on County
Surveyor's Map No. 8193 on file in the office of the Surveyor of
said County; thence North 58 17' 40" West 95.02 feet to said
intersection; thence along said centerline of LaReina Avenue,
South 32° 54' 10" West 130.99 feet; thence South 57° 131 50"
East 30.00 feet to a 2 inch pipe set in cement in the Southeasterly
line of said LaReina Avenue; thence North 32 54' 10" East 81.95
feet along a line parallel to and 30.00 feet measured at right
angles, from centerline of said LaReina Avenue; to the true point
of beginning; thence 31.00 feet along a circular curve concave to
the South with a radius of 20.00 feet and through an angle of 88
48' 10 thence South 58 17' 40" East along a line parallel to
and 30.00 feet measured at right angles from the centerline of
said Fifth Street, 45.43 feet to a point on a line parallel to
centerline of said LaReina Avenue; thence 10.00 feet along said
parallelline North 32° 54' 10" East to a point on a line parallel
to and 20.00 feet, measured at right angles, from the centerline
of said Fifth Street; thence along said parallel line North 58°
17' 40" West 65.02 feet to a point on a line parallel to centerline
of said LaReina Avenue and passing through the true point of begin-
ning; thence along said line South 32 54' 10" West 29.59 feet to
the true point of beginning.
PARCEL 2
That portion of the Tract of the Downey Land Association in
the City of Downey, County of Los Angeles, State of California, as
per map recorded in Book 2, Page 434 of Miscellaneous Records in
the office of the County Recorder of said County, described as
follows:
Beginning at a point on the centerline of Fifth Street, distant
South 58° 17' 40" East 95.02 feet from a 3/4 inch pipe set in cement
at the intersection of said centerline with the centerline of LaReina
Avenue, formerly Depot Street, as shown on County Surveyor's Map No.
8193 on file in the office of the Surveyor of said County; thence
parallel with the centerline of said LaReina Avenue South 32 54' 10"
West 20.00 feet to the true point of beginning; thence parallel with
centerline of said Fifth Street, South 58 17' 40" East 45.01 feet;
thence parallel with centerline of said LaReina Avenue South 32 54'
10" West 10.00 feet; thence parallel with centerline of said Fifth
Street North 58 17' 40" West 45.01 feet; thence parallel with
centerline of said LaReina Avenue, North 32 54' 10" East 10.00 feet
to the true point of beginning.

the City of Downey, County of Los Angeles, State of California,
as per map recorded in Book 2, Page 434 of Miscellaneous Records,
in the office of the County Recorder of said County, described as
follows:
Beginning at a point on the centerline of Fifth Street,
—' distant South 58 17' 40" East 140.03 feet from a 3/4 inch pipe
set in cement at the intersection of said centerline with the center-
line of LaReina Avenue ( formerly Depot Street) as shown on
County Surveyor's Map No. 8193 on file in the office of the Surveyor
of said County; thence parallel with centerline of LaReina Avenue,
South 32 C 5 10 West 20.00 feet to the true point of beginning;
thence parallel with centerline of said Fifth Street, South 58° 17'
40" East 45.01 feet; thence parallel with centerline of said LaReina
Avenue, South 32 54' 10" West 10.00 feet; thence parallel with
centerline of said Fifth Street, North 58' 17' 40" West 45.01 fe t;
thence parallel with centerline of said LaReina Avenue, North 32
54' 10" East 10.00 feet, back to the true point of beginning.

That portion of the Tract of the Downey Land Association, in
the City of Downey, County of Los Angeles, State of California, as
per map recorded in Book 2, Page 434 of Miscellaneous Records, in
the office of the County Recorder of said County, described as
follows:
Beginning at a point in the centerline of Fifth Street that is
distant thereon South 58 17' 40" East 274.64 feet from a 3/4 inch
pipe set in cement at the intersection of said centerline with the
centerline of LaReina Avenue (formerly Depot Street) as shown on
County Surveyor's Map No. 8193 on file in the office of the County
Surveyor of said County; thence along a line parallel with center-
line of said LaReina Avenue, South 32 54' 10" West 20.00 feet to
the true point of beginning; thence continuing along said parallel
line South 32° 54' 10" West 10.00 feet; thence parallel wfth center-
line of said Fifth Street, North 58° 17' 40" West 89.50 feet; thence
parallel with centerline of said LaReina Avenue, North 32 524 10"
East 10.00 feet; thence parallel with centerline of said Fifth Street,
South 58 17' 40" East 89.50 feet, back to the true point of begin-
ning.
PARCEL 5
That portion of the Tract of the Downey Land Association in the
City of Downey, County of Los Angeles, State of California, as per
map recorded in Book 2, Page 434 of Miscellaneous Records in the
office of the County Recorder of said County, more particularly
described as follows:
Beginning at a point in the centerline of Fifth Street, distant
South 58 17' 40" East 274.64 feet from a 3/4 inch pipe set in cement
at the intersection of said centerline with the centerline of LaReina
Avenue (formerly Depot Street) as shown on County Surveyor's Map
No. 8193 on file in the office of the Surveyor of said County; thence
.— parallelwith the centerline of said LaReina Avenue, South 32 54' 10"
West 20.00 feet to the true point of beginning; thence parallel with
centerline of said Fifth Street, South 58° 17' 40" East 65.01 feet
to a line which is parallel with centerline of New Street and 25.00

thence 18.57 feet along a circular curve, concave to the West,
with a radius of 20.00 feet, and through an angle of 53 12'
05" to a line parallel with the centerline of said Fifth Street
and 30.00 feet, measured at right angles Southwest of said
centerline; thence along said parallel line, North 58° 17' 40"
West 47.76 feet; thence along a line parallel with said LaReina
_ Street, North 32 54' 10" East 10.00 feet to the true point of
beginning.
SECTION 4. That the City Attorney of the City of Downey
and Burke, Williams & Sorensen hereby are authorized, empowered,
and directed to prepare, institute, and to prosecute in the name
of the City of Downey such proceedings in the proper court having
jurisdiction thereof as are necessary for the condemnation of
said rights of way in said real property described in Section 3
of this resolution.
Said attorneys hereby are authorized and empowered to take
such procedure as may be necessary to secure an Order of
Immediate Possession for the use and occupancy of said property.
SECTION 5. That the City Clerk shall certify to the
adoption of this resolution, and thenceforth and thereafter the
same shall be in full force and effect.
