HomeMy WebLinkAboutResolution No. 1084 1.675 RESOLUTION NO. 1084 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ESTABLISHING RATES FOR THE SERVICE OF WATER BY THE CITY, AND RULES AND REGULATIONS FOR THE SERVICE OF WATER BY THE CITY THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The following bi- monthly rates hereby are established and shall be collected by the Water Division of the City through the Director of Finance for water furnished by said City through water meters: 1. For the first 3000 cubic feet or less, at the rate of 15c per hundred cubic feet. 2. For all water furnished in excess of 3000 cubic feet, at the rate of 7 per hundred cubic feet or any portion thereof. The minimum bi- monthly rate for water furnished through meters shall be as follows: Size of Meter Minimum Amount 3/4 " $3.00 1 " 4.00 1 -1/2 " 5.00 2 " 6.00 3 '' 7.00 4 " 8.00 Over 4 " 2.00 per inch or portion thereof For apartments, add 50c to minimum for each additional apartment on same meter. For hotels, add 25c to minimum for each room on the same meter. For each business on the same meter, add $3.00 to minimum. Except as otherwise specified in this resolution, for all water served other than through a meter, there shall be a weekly charge of $7.50. The minimum fee shall be charged unless the shut -off is ordered by the owner or tenant. SECTION 2. Water furnished to and used by City Departments or served to City buildings shall be at the rates set forth in Section 1. SECTION 3. For water furnished through fire hydrants, a charge of $1.50 per hydrant per month shall be made against the Fire Department of the City, which rates shall cover the use of water by said Fire Department through all fire hydrants throughout the corporate limits of the City. For water furnished through fire protection meters, a charge of $0.50 per inch per month shall be made against the user, which rate shall cover the use of the water. SECTION 4. Payment of water charges. Water statements shall be made bi- monthly and meter shall be read approximately each sixty days. Water charges are due and payable upon presentation and shall become delinquent if not paid before the 20th day after date of mailing. If any account becomes delinquent, the Water Division may shut off the water from the premises concerned. III 1676 There shall be a charge of $2.50 for the turning on of any water service after a shut -off by reason of delinquency. SECTION 5. The Water Division shall install a service and at such location as the applicant requests, providing such requests are reason- able. The service will be installed from its nearest water distribution main to the curb line, or adjacent to the property line of the premises abutting the street, utility right of way or easement. Charges for installation of a service including tapping and meter service, which charges shall be payable in advance, shall be as follows: Size of Meter Charge 3/4 " $ 40.00 1 " 60.00 1 -1/2 " 115.00 2 " 150.00 Over 2 " Actual cost For all extensions required between the nearest distribution main and the curb line or property line as set forth hereinabove, there shall be charged the actual cost, a deposit in the amount of the estimated cost shall be made with the City prior to any installation. SECTION 6. In case of change of ownership or tenancy of any premises, the new owner or tenant shall make written application for water service upon a form provided by the Water Division. The application in all in- stances shall contain the name and address of the applicant, the legal description and street number of the property, and an agreement upon the part of the applicant to pay the stipulated rate at the time and in the manner provided by any applicable resolution or ordinance of the City and to abide by all rules and regulations of the Water Division. The water shall not be turned on until the application is signed. Prior to the time water is turned on pursuant to any application, in addition to any other charges required by the resolution, a $5.00 deposit shall be made with the City and a $10.00 deposit if the applicant has caused the water to be turned on prior to the signing of the application. At the termination of any service, such deposit shall be returned after there has been deducted therefrom any monies due and owing the City for water service. SECTION 7. For a temporary hook -up to fire hydrants or other facili- ties, there shall be a charge of $7.50 plus a $5.00 deposit. Water shall be charged for at the same rate as specified in Section 1 hereof with a minimum of $3.00 for each month. SECTION 8. In the event any meter fails to operate properly or to register the water used, the charge shall be based upon the average of the three months immediately preceding the period in which such meter fails to operate. SECTION 9. Each applicant shall be responsible for the cost of any water lost through leaks or defective lines between the meter and the point of use. SECTION 10. The City shall have the right at any time to shut off any water by reason of any emergency, for making repairs, modifications, changes or other work in the water service facilities. SECTION 11. There shall be a $1.00 deposit with each written request to check a meter for accuracy. In the event of such examination and test of meter the meter shall be found to register over 2% more water than 167 7 actually passes through it, another meter will be substituted therefor and the deposit shall be repaid to the person making the request. If the meter shall be found to register not over 2% more water, the deposit shall be forfeited and the meter reinstalled. SECTION 12. The City Clerk shall certify to the adoption of this -- resolution.
