HomeMy WebLinkAboutResolution No. 1033 8 RESOLUTION NO. - . 3 1) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE CONSTRUCTION OF CERTAIN SANITARY SEWERS IS NECESSARY AS A HEALTH MEASURE ON DUESLER LANE, A PRIVATE STREET, WITHIN �=. THE CITY OF DOWNEY (PROPOSED ASSESSMENT DISTRICT NO. 22 - DUESLER LANE) THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Downey has care- fully considered all of the matters relating to the proposed construction of sanitary sewers and appurtenances thereto in and along Duesler Lane, a private street, between a point 230 ♦ feet easterly of the centerline intersection of Paramount Boulevard of said Duesler Lane and a point 830 feet easterly from the intersection of the centerline of Paramount Boulevard and Duesler Lane. SECTION 2. That the Health Officer of the County of Los Angeles, acting as the Health Officer of the City of Downey by appointment, has rec- ommended as a health measure the institution of proceedings so as to con- struct and install sanitary sewers in and along the above - described streets. Said recommendations were given to the said City in writing and were spread in their entirety upon the minutes of the Council Meeting of the City Council of the City of Downey held on September 11, 1962. SECTION 3. In accordance with the provisions of Section 2808 of the Streets and Highways Code of the State of California, to which reference hereby is made, relating to the exemption of proceedings for the construction of sanitary sewers from the provisions of the "Special Assessment Investiga- tion, Limitation and Majority Protest Act of 1931," the City Council of the City of Downey hereby does find and determine in conformity with the said Health Officer's recommendation that said construction is necessary as a health measure. SECTION 4. The proceedings for such improvement shall be in accordance with the "Improvement Act of 1911," being Division 7 of the said Streets and Highways Code. SECTION 5. The City Engineer is directed to prepare suitable maps, plans, and specifications therefor and to submit the same to the City Council. SECTION 6. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
