A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF A CERTAIN EASEMENT KNOWN AS
PLANETT AVENUE EXTENDING NORTHERLY FROM IOWA STREET
LOCATED BETWEEN DOLAN AVENUE AND BROOKSHIRE AVENUE

WHEREAS, by Resolution No. 1017 the City Council of the City of
Downey, adopted the 13th day of August, 1962, the City Council declared
its intention to vacate a certain easement known as Planett Avenue for
public road purposes extending northerly from Iowa Street located
between Dolan Avenue and Brookshire Avenue, and setting a hearing there-
on for the hour of 7:30 P.M. on the llth day of September, 1962; and
WHEREAS, the public hearing on said intended vacation duly was held
and a full and fair hearing was had thereon.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. The City Council finds from all the evidence submitted
at said hearing that the easement known as Planett Avenue hereinafter
described is unnecessary for present or prospective street purposes, and
it is hereby ordered vacated. Said area so vacated is described as fol-
lows:
That portion of Block 1 of Tract No. 9457, in the City of Downey
County of Los Angeles, State of California, as per map recorded
in Book 171, Page 7 of Maps, in the office of the County Recorder
of said County, described as follows:
Beginning at a point in the Southwesterly line of said block,
distant South 57 East 200 feet from the most Westerly
Corner of said Block 1; thence North 30 ° 53'30" East 202.57
feet thence South 57 ° 42'30" East 30 feet; thence South 32 ° 53'30"
West 202.57 feet; thence North 57 ° 42'30" West 30 feet to the point
of beginning.
The above described land is shown as Parcel 14, as shown on a
map filed in Book 56, Page 47 of Record of Surveys.
SECTION 2. The City Council of the City of Downey does reserve and
except from the vacation the permanent easement and right at any time, or
from time to time, to construct, maintain, operate, replace, remove and
renew sanitary sewers and storm drains and appurtenant structures in,
upon, over and across that portion of the street or part thereof proposed
to be vacated, described in the sanitary sewer easement to the County of
Los Angeles, registered August 30, 1946, as Document No. 20546.0, including
the right to keep the property freefrom inflammable materials, and wood
growth, and otherwise protect the same from all hazards in, upon and over
the street or part thereof proposed to be vacated of all that certain real
property described in the sanitary sewer easement to the County of Los Ange-
les, registered August 30, 1946, as Document No. 20546.0, described as
follows:
..� That portion of Block 1, Tract No. 9457, which lies within the south-
easterly 6 feet of the northwesterly 16 feet of Parcel 14, as shown
on map filed in Book 56, Page 47 of Record of Surveys of the County
of Los Angeles, State of California.

SECTION 3. That the public convenience and necessity requires the
reservation of the easement and right of way as enumerated above, and that
the proceedings are taken subject to such reservations and exceptions.
SECTION 4. The City Council of the City of Downey hereby does
proceed to vacate the said portion of said easement under the provisions
of Part 3, Division 9 of the Streets and Highways Code of the State of
California.
SECTION 5. The City Clerk shall certify to the adoption of this
resolution and cause a certified copy thereof, attested by the City Clerk
under the Seal of the City of Downey, to be recorded in the office of the
County Recorder of the County of Los Angeles.
