HomeMy WebLinkAboutResolution No. 0989 15&1.3 RESOLUTION NO. 989 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THINGS WHICH CREATE AN OBSTRUCTION TO VIEW AND A TRAFFIC HAZARD AT INTERSECTIONS SHOULD NOT EXCEED 30" IN HEIGHT WHEREAS, Section 4800 of the Downey Municipal Code provides, in effect, that no person owning or in possession of real property located at a corner formed by intersecting streets shall allow or permit any shrubbery, sign, or other device within a certain triangular area on said property, all as set forth in said section, which would obstruct or interfere with the view of a driver of a vehicle approaching the intersection; and WHEREAS, the Traffic Engineer and the Chief of Police have caused studies to be made as to the maximum height such obstructions may exist at such an intersection and upon such properly without constituting a hazard or obstructing the view of a driver; and WHEREAS, by reason of the large number of sport cars and compact cars now being driven upon the streets, it has been determined that no such shrubbery or other obstruction upon such property at such an intersection and within such an area should exceed 30" above the street level, as any obstruction in excess of such height would interfere with the view of the driver of a vehicle approaching the intersection; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby declares as a matter of policy that the protection of the public peace, health, safety and welfare requires that no hedge, shrubbery, natural growth, sign, device, or other obstruction as specified in Section/B00 of the Downey Municipal Code within the triangular area defined within said section shall exceed 30" in height above street level. SECTION 2. The proper administrative officials shall administer this declaration of policy with due regard to the public peace, health, safety, and welfare of those using the streets of the City of Downey and with due regard to the rights of property owners which may be affected by such policy. SECTION 3. That the City Clerk shall certify to the adoption of this resolution.
