HomeMy WebLinkAboutResolution No. 0943 1478 RESOLUTION NO. 943 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY EXPRESSING ITS UNQUALIFIED OPPOSITION TO THE PROPOSED ALLOCATION OF CITY-ALLOCATED LIQUOR LICENSE REVENUE TO COUNTIES WHEREAS, it has been proposed to re-allocate three - fourths of the liquor license revenue now received by cities, to counties; and WHEREAS, this proposal is based on the argument that the Legislature in 1961 revised our vagrancy laws to define prostitution and intoxication as violations of "State Laws" and their incarceration a county expense, thus occupying a field in which cities had previously enforced ordinances, and thus entitling counties to liquor license fees which they contend are allocated for the purpose of enforcing State liquor laws, including "drunk" laws; and WHEREAS, liquor license fees are actually allocated back to the jurisdiction of the licensee by the State, acting as the collecting agent for what was before prohibition a local city tax; and WHEREAS, the subject proposal would work a gross inequity on the people of this State, by forcing cities to pay not only the general county levy which supports county jails and patrols and prisoner maintenance for unincorporated areas, as well as special fees for holding city prisoners; but also would require cities to pay twice for the custodial costs of those violating State laws; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That this Council expresses its unequivocal opposition to allocating any city liquor license fees to counties; and SECTION 2. That the City Clerk shall certify to the adoption of this resolution and shall forward certified copies thereof to the Governor and members of the Legislature representing the people of this City.
