Y',sf 5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CON- VENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR STREET PURPOSES (Brookshire Avenue) THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest and necessity require the acquisition of rights of way in, over and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and lo- cated in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that, in order to acquire said rights of way in, on, over and under said land for said street purposes and use the same for said purposes, the public interest, convenience and necessity require the acquisition of the rights of way by the City of Downey in, on, over and under that certain real property hereinafter described, and the City Council hereby declares it is the intention of the City of Downey to acquire in its name said rights of way in, on, over and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authorizing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by the public interest, convenience and necessity for the purpose set forth in Sections 1 and 2 hereof, is described as follows: Parcel 1 - That portion of Block 5 of the Tract of the Downey Land Association, as per map recorded in Book 2, Page 434 of Miscellaneous Records of Los Angeles County, described as follows: Beginning at a point in the Northwesterly line of Brookshire Avenue, g g P y formerly Church Street, 60 feet wide, that is South 32 ° 49'20" West thereon 36.11 feet from the Southwesterly line of First Street 60 feet wide, as shown on the map of Tract No. 2707 recorded in Book 33, Page 75 of Maps, records of said county, said point of beginning being the most Southerly corner of the land described in the deed recorded in Book 14398, Page 78 of Official Records of said county; thence continuing along said Northwesterly line of Brookshire Avenue, South 32 ° 49'20" West, 191.89 feet to the Southwesterly line of the land described in the deed to L. Murphy and Selma Margaret Murphy, recorded November 5, 1926, as Instrument No. 425 in Book 6379, Page 378 of said Official Records; thence along said Southwesterly line North 57 ° 05'50" West 10 feet; thence parallel with said North westerly line of Brookshire Avenue, North 32 ° 49'20" East 143.97 feet; thence North 60 ° 22'06" West 2 feet• thence parallel with said Northwesterly line of Brookshire Avenue, North 32 East 44.25 feet; to a point that is South 32 West 15.11 feet from the existing Southwesterly line of Firestone Boulevard, per deed recorded in Book 13814, Page 153; thence North 13 ° 46'23" West 20.61 feet to said South- --- westerly line of Firestone Boulevard; thence thereon South 60 ° 22'06" East 15.01 feet to a point that is North 60 ° 22'06" West 12.00 feet from said Northwesterly line of Brookshire Avenue; thence along the Westerly line of the land described in Book 14398, Page 78 of Official Records, South 13 East 16.49 feet to the point of beginning. 1t.3t. : Parcel 2 - That portion of Block 6 of the Tract of the Downey Land Association as per map recorded in Book 2, Page 434 of Miscellaneous Records of Los Angeles County, described as follows: Beginning at a point in the Southeasterly line of Brookshire Avenue, formerly Church Street, 60 feet wide, distant Southwesterly thereon 38.00 feet from the existing Southwesterly line of Firestone Boulevard, as described in the deed recorded in Book 13775, Page 253 of Official Records of said county, said point of beginning being the most Westerly corner of the land described in the deed to the County of Los Angeles, recorded in Book 14279, Page 312 of said Official Records; thence con- tinuing along said Southeasterly line of Brookshire Avenue, South 32 West 116.91 feet to the Southwesterly line of the land de- scribed in the deed to Elton L. Wallar and Dorothy L. Wallar, recorded September 22, 1954, as Instrument No. 2556 in Book 45648, Page 37 of said Official Records; thence thereon South 57 ° 05'50" East 10 feet; thence parallel with said Southeasterly line of Brookshire Avenue, North 32 49'20" East 138.48 feet to a point that is South 32 ° 49'20" West 17.00 feet from said Southwesterly line of Firestone Boulevard; thence North 76 ° 13'37" East 24.70 feet to said Southwesterly line; thence thereon North 60 22'06" West 18 feet to the most Easterly corner of said land deeded to the County of Los Angeles, in Book 14279, Page 312 of Official Records; thence along the Southeasterly line of said land, South 32 ° 49'20" West 38.50 feet to the most Southerly corner of said land; thence North 57 °10'40" West 9.00 feet to the point of beginning. Parcel 3 - Area A: The Southeasterly 20 feet of Block 1 of Tract No. 9457 as per map recorded in Book 171, Page 7 of Maps, records of Los Angeles County. Area B: Beginning at the most Westerly corner of the above described Parcel 1; thence along the Northeasterly line of Iowa Street as shown on the map of said tract, North 57 ° 42'30" West 14.86 feet to the beginning of a tangentourve concave Northerly and having a radius of 15 fett, said curve being also tangent to the Northwesterly line of said Parcel 1; thence Easterly along said curve 23.42 feet through a central angle of 89 ° 28'00" to eaid Northwesterly line; thence thereon South 32 ° 49'30" Wett 14.86 feet to the point of beginning. Parcel 4 - That portion of Block 5 of the Tract of the Downey Land Associa- tion in the County of IDs Angeles, State of California, as per map recorded in Book 2, Page 434, of Miscellaneous Records of said county, described as follows: Beginning at the Southeast corner of Block 5 of said Tract of the Downey Land Association; thence Northwesterly along the Southern Pacific Railway right of way 10 feet; thence Northeasterly 135 feet along a line parallel with and 10 feet Northwesterly, measured at right angles, from the North- westerly line of Brookshire Avenue (formerly Church Street, 60 fett in width), to the Southwesterly line of the land conveyed to L. Murphy and Selma Margaret Murphy, by Document No. 425 recorded November 5, 1926, in Book 6379, Page 378 of Official Records of Los Angeles County; thence Southeasterly along said line of Murphy 10 feet to the Northwesterly line of said Brookshire Avenue; thence Southwesterly along said line of Brook- shire Avenue, 135 feet to the point of beginning. SECTION 4. That the City Attorney of the City of Downey, and Burke, Williams & Sorensen, hereby are authorized, empowered and directed to prepare, institute and prosecute in the name of the City of Downey, such proceedings in the proper court having jurisdiction thereof as are necessary for the condemna- tion of said rights of way in said real property described in Section 3 of this resolution. r Said attorneys hereby are authorized and empowered to take such pro- cedure as may be necessary to secure an order of immediate possession for the use and occupancy of said property. SECTION 5. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this C3/-1 day of 0 , 1961.
