Y A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVEN- IENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR STREET PURPOSES (CHEROKEE DRIVE AND DOWNEY AVENUE) THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest and necessity require the acquisition of rights of way in, over and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and lo- cated in the manner which will be most compatible to the greatest public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that, in order to acquire said rights of way in, on, over and under said land for said street purposes and use, the same for said purposes, the public interest, conven- ience and necessity require the acquisition of the rights of way by the City of Downey in, on, over and under that certain real property hereinafter desribed, and the City Council hereby declares it is the intention of the City of Downey to acquire in its name said rights of way in, on, over and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California authoriz- ing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is required by the public interest, convenience and necessity for the purpose sit forth in Sec - tions 1 and 2 hereof, is described as follows: That portion of real property in the CITY OF DOWNEY, County of Los Angeles, State of California, described as that part of the Northwesterly 195 feet of that portion of Parcel 3, as shown on the map of the property of A. B. Graham et al., in the Rancho Santa Gertrudes, attached to deed recorded in Book 6583 Page 290 of Deeds in the office of the County Recorder of said county, as follows: Beginning at the Southwesterly corner of said Parcel 3; thence along the Southerly line therec4 South 58 ° 39' East 195.00 feet to the Southeasterly line of the land conveyed to Charles J. Miller and Catherine G. Miller by Document No. 4998 recorded February 13, 1958 in Book D -11 Page 693 of Official Records in the said County Recorder's office; thence along said Southeasterly line North 31 ° 15'10" East 27.00 feet; thence parallel with said Southerly line North 58 ° 39' West 165.03 feet to the beginning of a tangent curve concave Easterly and having a radius of 15.00 feet; thence along said curve 23.54 feet through a central angle of 89 ° 54'10" to a tangent line that is parallel with and 15.00 feet distant Southeasterly when measured at right angles from the Northeasterly line of said Parcel 3; thence along the last mentioned parallel line g P North 31 ° 1510" East 98.77 feet; thence North 58 ° 39' West 15.00 feet to the said Northeasterly line; thence along said Northeasterly line, South 31 ° 15'10" West 140.74 feet to the point of beginning. SECTION 4. That the City Attorney of the City of Downey, and Burke Williams & Sorensen, hereby are authorized, empowered and directed to prepare, institute and prosecute in the name of the City of Downey, such proceedings in the proper court having jurisdiction thereof as are necessary for the condemna- tion of said rights of way in said real property described in Section 3 of this resolution. q too 10 Said attorneys hereby are authorized and empowered to take such procedure as may be necessary to secure an order of immediate possession for the use and occupancy of said property. SECTION 5. The City Clerk shall certify to the,adoption of this resolution.
