D A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CON- VENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTY FOR STREET PURPOSES (FOSTER ROAD AND WOODRUFF AVENUE) THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council hereby finds, determines and declares that the public interest and necessity require the acquisition of rights of way in, over and under the hereinafter described real property for public street purposes and all uses appurtenant thereto. That the location of the land for said street has been planned and located in the manner which will be most compatible to the great- est public good and the least private injury. SECTION 2. That the City Council finds, determines and declares that, in order to acquire said rights of way in, on, over and under said land for said street purposes and use the same for said purposes, the public interest, convenience and necessity require the acquisition of the rights of way by the City of Downey in, on, over and under that certain real property hereinafter described, and the City Council hereby declares it is the intention of the City of Downey to acquire in its names said rights of way in, on, over and under said hereinafter described real property by condemnation in accordance with the provisions of the Code of Civil Procedure and the Constitution of the State of California author- izing the exercise of the right of eminent domain. SECTION 3. That said real property, the acquisition of which is re- quired by the public interest, convenience and necessity for the purpose set forth in Sections 1 and 2 hereof, is described as follows: That portion of the land described in the deed to Stone Investment, Inc., a Corporation, by deed recorded September 4, 1958 as Instrument No. 1625 in Book D -206, Page 313 of Official Records of Los Angeles County, being part of the Southwest Quarter of the Northwest Quarter of Section 14, Township 3 South, Range 12 West, in the Rancho Santa Gertrudes: Parcel 1 - Beginning at the Southwest corner of said Northwest Quarter; thence North 0 ° 05'30" West along the Westerly line of said Northwest Quarter, 167.20 feet; thence along the Northerly line of the land described in the above - mentioned deed, North 89 ° 50'25" East 50 feet; thence parallel with said Westerly line South 0 ° 05'30" East 167.20 feet to the Southerly line of said Quarter- Section; thence thereon South 89 ° 50'25" West 50 feet to the point of beginning. To be known as Woodruff Avenue. Parcel 2 - Beginning at the Southwesterly corner of the above - described Parcel 1; thence along the Easterly line of said parcel, North 0 ° 05'30" West 55.02 feet to the beginning of a tangent reversing curve concave Northeast- erly and having a radius of 15 feet; thence Southeasterly along said curve through a central angle of 90 ° 04'05" an arc distance of 23.58 feet to a point of tangency with a line that is parallel with and 40 feet Northerly, measured at right angles, from the Southerly line of said Northwest Quarter - Section; thence along said parallel line North 89 ° 50'25" East 83.62 feet to the Easterly line of the land described in the above - mentioned deed; thence thereon South 19 ° 11'57" West 42.40 feet to said Southerly line; thence thereon South 89 ° 50'25" West 84.64 feet to the point of beginning. To be known as Foster Road. 1293 SECTION 4. That the City Attorney of the City of Downey, and Burke, Williams and Sorensen hereby are authorized, empowered and directed to prepare, institute and prosecute in the name of the City of Downey such proceedings in the proper court having jurisdiction thereof as are nec- essary for the condemnation of said rights of way in said real property described in Section 3 of this resolution. Said attorneys hereby are authorized and empowered to take such procedure as may be necessary to secure an order of immediate possession for the use and occupancy of said property. SECTION 5. The City Clerk shall certify to the adoption of this resolution. APPROVED AND ADOPTED this day of , 1961.
