RESOLUTION NO. 768
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CON-
VENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CER-
TAIN PROPERTY FOR STREET PURPOSES (GALLATIN ROAD)
•—. THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council hereby finds, determines, and declares
that the public interest and necessity require the acquisition of rights of way
in, over and under the hereinafter described property for public street purposes
and all uses appurtenant thereto.
That the location of the land for said street has been planned and located in
the manner which will be most compatible to the greatest public good and the least
private injury.
SECTION 2. That the City Council finds, determines, and declares that, in
order to acquire said rights of way in, on, over and under said land for said
street purposes and use the same for said purposes, the public interest, con-
venience and necessity require the acquisition of the rights of way by the
City of Downey in, on, over and under that certain real property hereinatter
described, and the City Council hereby declares it is the intention of the
City of Downey to acquire in its name said rights of way in, on, over and under
said hereinafter described real property by condemnation in accordance with the
provisions of the Code of Civil Procedure and the Constitution of the State of
California authorizing the exercise of the right of eminent domain.
SECTION 3. That said real property, the acquisition of which is required
by the public interest, convenience and necessity for the purpose set forth in
Sections 1 and 2 hereof, is described as follows:
Parcel 1 - That part of the following described portion of the Rancho
Santa Gertrudes, in the City of Downey, County of Los Angeles, within
the lines of the land conveyed to Ben J. Hughes and Agnes M. Hughes by
Certificate of Title No. 1 AF - 110881 registered February 29, 1952 as
Document No. 3661 - U in . the office of the Registrar of Titles of said
county:
Beginning at a point'in the center line of Gallatin School House
Road (now Gallatin Road) as said center line is shown on County Sur-
veyor's Map No. B -2061, on file on the office of the County Engineer
of said county, and on the map of Tract No. 20507, recorded in Book
543, Page 14 of Maps, in the office of the Recorder of said county,
that is N rth 52 °30'00" West thereon 644.44 feet from the center line
of Lakewood Boulevard (80 feet widel as per deed recorded in Book
14038, Page 72 of Official Records of said county; thence South 37 °30'
West 34.00 feet to the beinning of a curve concabe Northeasterly and
having a radius of 5034 feet (a radial line beats North 37 ° 30' East);
thence Northwesterly along said curve 293.23 feet rhough a central
angle of 3 2o'15" to the beginning oa a reversing curve concave South-
erly and having a radius of 23 feet, said last mentioned curve being
tangent to a line that is parallel with and 34 feet Southeasterly,
measured at right angles, from that portion of the center line of Lex-
ington and Gallatin Road shown on said County Surveyor's Map No. B -2061
as having a bearing of South 41 ° 30'50" West; thence Westerly along said
last- mentioned curve 35.96 feet through a central angle of 89 ° 19' 24
to the end thereof; thence North 48 ° 28'10" West 34 fett to said last -
mentioned center line; thenced thereon North 41 ° 30'50" East 18.58 feet
to an angle point; thence North 53 ° 22'40" East 26.93 feet to the North-
westerly prolongation of the tangent portion of said center line of
Gallatin Road; thence thereon South 52 °30' East 342.59 feet to the
point of beginning.
Parcel 2 - That portion of Lot 1 in Block G of Tract No. 212, in the
City of Downey, County of Los Angeles, as per map recorded in Book 14,
Pages 54 and 55 of Maps, records of said county, described as follows:

Pages 28 and 29 of said Maps; thence along said Northewasterly line
of Gallatin School House Road, North 42 West 158.72 feet to
the Southeasterly line of the land described in the deed to Lloyd
C. Wilson recorded November 28, 1950 in Book 34963, Page 32 of
Official Records of said county; thence thereon North 53 ° 20'00"
East 12.06 feet to a line that is parallel with and 12 feet North-
easterly measured at right angles, from said Northeasterly line;
thence along said parallel line South 42 ° 08'30" East 135.81 feet to
the beginning of a tangent curve concave Northerly and having a
radius of 23 feet, said curve being also tangent to a line that is
parallel with and 2 feet Northwesterly measured at right angles
from said Northwesterly line of Downey Avenue; thence Easterly along
said curve through a central angele of 84 ° 31'30" a distance of 33.93
feet to the end thereof; thence South 36 ° 40'00" East 2 feet to said
Northwesterly line of Downey Avenue; thence thereon South 53 ° 20'00"
West 32.77 feet to the point of beginning.
SECTION 4. That the City Attorney of the City of Downey and Burke, Williams
& Sorensen hereby are authorized, empowered and directed to prepare, institute and
prosecute in the name of the City of Downey such proceedings in the proper court
having jurisdiction thereof as are necessary for the condemnation of said rights
of way in said real property described in Section 3 of this resolution.
Said attorneys hereby are authorized and empowered to take such procedure as
may be necessary to secure an order of immediate possession for the use and occu-
pancy of said property.
SECTION 5. The City Clerk shall certify to the adoption of this resolution.
