HomeMy WebLinkAboutResolution No. 0750 i I RESOLUTION NO. 750 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING CERTAIN LIGHTING FIXTURES, APPURTENANCES, AND APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES OF SAID CITY TO BE MAINTAINED AND ELECTRIC CURRENT TO BE FURNISHED, ALL IN ACCORDANCE WITH RESOLUTION NO. 728 OF SAID CITY ( DOWNEY CITY LIGHTING DISTRICT, ANNEXATION 2, ZONE 3) WHEREAS, the City Council of the City of Downeti, on December 12, 1960, adopted Resolution No. 728 ordering the City Engineer to prepare plans, specifications, estimate, and report pursuant to the provisions of Division 14, Part 1, Streets and Highways Code, State of California; and WHEREAS, on December 12, 1960, in compliance with the order of the City Council as set forth in said Resolution No. 728. the City Engineer did file with the City Clerk the plans specifications, estimate, and report in writing; and WHEREAS, on December 12, 1960, said matter so filed was submitted to the City Council, and the City Council approved said report and did adopt Resolution No. 729 declaring its intention to order those certain improvements as aforesaid; and WHEREAS, ON December 12, 1960, the City Council by Resolution No. 730, appointed the hour of 7:00 P.M., January 9th,1961 as the time and place for hearing protests in relation to said proposed improvement; and WHEREAS, on January 9th,1961 the hearing was continued to 7:30 P.M. on January 16th,19t1 at which time and place as specified, a publis hearing was held in relation to said improvement, all in accordance with said Resolution No. 730, notice having been duly given of said hearing in the manner required by law; and WHEREAS, at said hearing the City Council did hear and pass upon all written and oral protests made in reference to said improvement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The boundaries of the Downey City Lighting District, Annexation 2, 4one 3, are described as shown in the document attached hereto designated as Exhibit A" and, by this reference, incorporated herein and made a part hereof, the same as though set forth in full. The District shall be divided into zones which shall be designated as, and shall be as, and the boundaries of each zone described are as shown on the document attached hereto designated "Exhibit A", and by this reference, made a part hereof the same as though set forth in full. SECTION 2. The District shall be named, designated, and known as the "Downey City Lighting District, Annexation 2, Zone 3." SECTION . The proposed improvment shall be for a period of time beginning from the formation of the district and ending March 31, 1963. SECTION 4. The proposed improvement consists of the furnishing of maintenance, and energy, for street lighting throughout the District as described all in accordance with the plans, specifications, and report of the City Engineer as approved by the City Council. SECTION 5. The estimated cost of said improvement for the first year ig $16,070.70 SECTION 6. The entire estimated cost of said improvement for the first year shall be borne by the District. The proportion of the estimated cost for the first year to be borne by each zone as follows: Zone 3 $16,070.70 A SECTION 7. It hereby is ordered that that portion of the estimated cost proposed to be borne by the District, shall be paid by special assessment taxes levied upon all the lands exclusive of improvements within the District and any zone therein. SECTION 8. It hereby is ordered that said proposed improvement, as described and set forth in Resolution No. 729 and in the report of the Engineer submitted pursuant to Resolution No. 728 be made in the manner and at the times prescribed by law. SECTION 9. That the City Council hereby finds that the Southern California Edison Company is the only contractor practically capable of serving the street lighting system to be improved in the manner provided for and as described herein and the Southern California Edison Company is subject to the jurisdiction of the Public Utilities Commission of the State of California. It, thereby, is ordered that the improvement of the said Lighting District be carried out in accordance with said plans and specifications by the Southern California Edison Company. SECTION 10. It, further, is ordered that the Mayor hereby is authorized and directed to execute the contract with the Southern California Edison Company for the improvement in accordance with said plan and specifications and in accordance with rates and rules filed by said Company from time to time with the Public Utilities Commission of the State of California. SECTION 11. The City Clerk shall certify to the adoption of this resolution and cause a certified copy thereof and the map or plan of the District to be filed with the assessor whose role is used for the levy and with the State Board of Equalization and, further, shall cause a copy of this resolution to bepublished once in the `Downey Live Wire."
