HomeMy WebLinkAboutResolution No. 0744 RESOLUTION NO. 744 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY RESCINDING RESOLUTION NUMBERS 731, 732, AND 733, AND DECLARING ITS INTENTION TO ORDER CEETAIN LIGHTING FIXTURES AND APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES IN THE CITY OF DOWNEY; TO BE MAINTAINED AND ELECTRIC CURRENT TO BE FURNISHED FOR LIGHTING SAID FIXTURES AND APPLIANCES FOR A PERIOD OF TWO YEARS. (DOWNEY CITY LIGHTING DISTRICT) THE CITY COUNCIL OF THE CITY OF DOWNEY HEREBY RESOLVES AS FOLLOWS: SECTION. 1. That the public interest and convenience require, and it is the intention of the City Council of the City of Downey to order certain fixtures and appliances on portions of streets, avenues, places, circles, parkways, courts, ways and drives within said City, all as shown on Diagram and Plan No. SL -12C on file in the office of the City Clerk, to be maintained, and electric current to be furnished for lightingsaid fixtures and appliances for a period of time beginning from the formation of the district and ending March 31, 1963 all in accordance with and beginning and ending in accordance with the Report of the City Engineer dated December 27, 1960 on file in the office of the City Clerk and which is hereby referred to and by this reference incorporated herein and made a part hereof. Pursuant to Section 18080, Chapter 5.5 of the "Street Lighting Act of 1919` being a part of Division 14 of the Streets and Highways Code of the State of California, the City Council of the City of Downey in lieu of establishing a new lighting district, declares its intention to annex the areas to be improved as shown on diagram and plan No. SL -12C described in the City Engineer's report of December 27, 1960 on file in the office of the City Clerk to the Downey City Lighting District. All of the work and improvement above specified shall be done in accordance with the specifications and plans heretofore referred to in the report of the City Engineer dated December 27, 1960 on file in the Office of the City Clerk and which is hereby referred to and by this reference incorporated herein and made a part hereof. SECTION 2. The City Treasurer shall establish a special fund known as Downey City Lighting District Fund, Zone 4, and said City Treasurer shall place in said special fund all monies collected by the Tax Collector pursuant to the provisions of Section 5 of this Resolution, as soon as said monies have been transferred to him. Payments shall be made out of said special fund only for the purposes pro- vided for in this Resolution. To expedite the making of this improvement, the City Council shall transfer into said special fund, out of any money in the general fund, such sums as it may deem necessary, and the sums so transferred shall be deemed a loan to such special fund and shall be repaid out of the proceeds of the assess- ments provided for in this Resolution. SECTION 3. The said contemplated work and improvement, in the opinion of the City Council, is of more than local or ordinary benefit, said Council hereby makes the expense of said work and improvements chargeable upon a district, which district said council hereby declares to be the district benefited by said work, and improve- ment, and to be assessed to pay the cost and expense thereof, which said district is that portion of the City of Downey as shown on Diagram and Plan No. SL -12C on file in the office of the City Clem., on which map the extent of said assessment district is indicated, and the exterior boundaries thereof are described, by a boundary line, and to which said map reference is hereby made for a complete and detailed description of said district, excepting from said district any portion of any public street or alley which may be excluded therein. The said diagram so on file shall govern for all details as to the extent of said assessment district. The exterior boundaries of said district are described as set forth in the attached Exhibit rr which is hereby referred to and incorpaated herein as though set forth in full. SECTION 4. Any lots or parcels of land known as public property, as the same is defined in Section 18014, of the Streets and Highways Code of the State of California (Street Lighting Act of 1919), hereinafter referred to, which are included in the said assessment district, shall be omitted and exempt from the assessment to be made to cover the costs and expenses of said contemplated improvement. SECTION 5. The improvement contemplated by this Resolution of Intention shall be done under the provisions of the "Street Lighting Act of 1919` being Part 1 of Division 14 of the Streets and Highways Code of the State of California, as amended and under the alternative procedure for ad valorem assessments provided for in Chapter 8.5 of the "Streit Lighting Act of 1919." SECTION 6. Resolution No. 732, hereby is rescinded. SECTION 7. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in fu`l force and effect. J. APPROVED AND ADOPTED this day of , ' 6 - , 19 L .
