HomeMy WebLinkAboutResolution No. 0691 A RESOLUTION NO. 9/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY PROPOSING TO CHANGE THE WORK TO BE DONE AND THE AREA INCLUDED IN ASSESSMENT DISTRICT NO. 4 +5. (DOLAN AVENUE AND OTHER STREETS AND RIGHTS OF WAY) WHEREAS, by Resolution No. 681 of the City Council of the City of Downey, adopted on the 27th day of September 1960, the said City Council found and determined that the construction of certain sanitary sewers was necessary as a health measure, pursuant to recommendation of the Health Officer, on Dolan Avenue and other streets and rights of way as described in the said resolution; and WHEREAS, by Resolution No. 682 of the said City Council, that certain map showing the boundary of the proposed assessment district designated as Map No. 45; and that certain Map No. 45R showing right of way acquisition for said Distrct, were approved and adopted; and WHEREAS, by Resolution No. 683, of the City Council of the City of Downey, adopted on the 27th day of September 1960, those certain profiles, plans and specifications were approved and adopted, said profiles, plans and specifications being identified, respectively, as: Profile and Plan No. 1 -13 -36 and "Assessment District No. 45 - Specifications - Sewer Improvement"; and WHEREAS, by Resolution No. 684 of the said City Council, adopted on the 27th day of September 1960, the said Council declared its intention to order the acquisition of certain rights of way as described in the said resolution and to order the work within the district as described in the said resolution; and WHEREAS, the City Council of the City of Downey has been advised by the Director of Public Works and the City Engineer that certain changes in the work to be done and the boundaries of said district should be made; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the said City Council of the City of Downey hereby proposes to change the work to be done as described in the said profile and improvement plans and specifications as described and set forth in the Resolution of Intention No. 684, and the boundaries -1- of the said district as set forth and described in said Resolution of Intention No. 684, as follows: (a) By modifying the assessment district described in said Resolution of Intention No. 684 as such modification is shown on that certain map No. 45A. (b) By modifying the work to be done in the said assessment district as described in said Resolution of Intention No. 684 as such modification is shown on that certain Profile and Improvement Plan No. 1- 13 -36A. Said Map No. 45A and Profile and Improvement Plan No. 1 -13 -36A are now on file in the office of the City Clerk and are available for examination to all interested persons. It is estimated that the proposed changes as hereinabove set forth will decrease the cost of work. to be done in said district by the sum of $1,972.06. SECTION 2. Notice hereby is given that on the 25th day of October 1960, at 8:00 o'clock A.M., any person interested in the proceedings referred to in said Resolution of Intention No. 68 and "-` having any objections to the changes ng proposed herein may appear before the said City Council and show cause why said changes should not be ordered, and any person interested may file written objections to the proposed changes with the City Clerk at any time not later than the date of the hearing, The City Clerk is directed to publish this reso- lution twice in the "Downey Live Wire ", the first publication to be at least ten (10) days prior to the date of the above hearing. SECTION 3. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
