(_ A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FOR THE ACQUISITION OF NECESSARY RIGHTS OF WAY AND CONSTRUCTION OF IMPROVEMENTS IN ASSESSMENT DISTRICT NO. 64 (STAMPS AVENUE) WHEREAS, the report prepared pursuant to Division 4 of the Streets and Highways Code, said division being the Special Assess- ment Investigation, Limitation, and Majority Protest Act of 1931, covering the proposed acquisition of necessary rights of way and construction of improvements under Improvement District No. 64 (Stamps Avenue), is on file in the office of the Clerk of the City Council of the City of Downey and may be examined at said office; and WHEREAS, said report has been submitted to, and approved by, the City Council, and a hearing has been set thereon; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest, convenience, and necessity require, and it is the intention of the City Council, pur- suant to the provisions of Division 12 of the Streets and Highways Code of the State of California, said division being the Municipal Improvement Act of 1913, to order the acquisition of the necessary rights of way and to order work to be done and improvement made all in the City of Downey, State of California, as follows, to wit: First: The acquisition of rights of way for street purposes, by gift, purchase, or eminent domain proceedings, consisting in general of the following: Parcel 1 That portion of Lots 3 and 4, Block "F" of Tract 212, in the City of Downey, County of Los Angeles, State of California, as per Map recorded in Book 14, Pages 54 and 55 of Maps, in the office of the County Recorder of said County, described as follows: Beginning at the most Westerly corner of said Lot 4, Block "F" of Tract 212; thence along the Northwesterly line of said Lot 4, North 53 Olt 48" East a distance of 254.288 feet; thence South 36 58 12" East a distance of 283.08 feet to the true point of beginning; thence North 53 01 48" East a distance of 13.54 feet to a point on a curve concave to - the Southeast having a radius of 40 feet; thence Northeasterly along said curve through a central angle of 74 311 57" an are distance of 52.03 feet to the beginning of a reverse curve concave to the Northwest having a radius of 40 feet; thence Northeasterly along said curve through a central angle of 33 07 23" and an arc distance of 23.13 feet; thence North 53w 01 48" East a distance of 620.528 feet to the beginning of a tangent curve concave to the West and having a radius of 20 feet; thence North along said curve through a central angle of 102 04! 53" an are distance of 35.63 feet; thence following semi - tangent of said curve South 49 03 05" East a distance of 96.13 feet ending as the semi- tangent of a curve concave to the South and having a radius of 20 feet; thence Northwest along said curve through a central angle of 77 55 07" an are distance of 27.20 feet; thence tangent to said curve South 53 41 48" West a distance of 640.638 feet to the beginning of a tangent curve concave to the Southeast and having a radius of 40 feet; thence Southwest along said curve through a central angle of 33 07 23" and an are distance of 23.12 feet to a point of reverse curvatures; thence Southwest along said curve through a central angle of 93 07 23" an arc distance of 65.01 feet; thence South 53 01 48" West along said line a distance of 3.00 feet; thence North 36 58 12" West a distance of 6.46 feet to a point on a curve concave to the Northeast and having a radius of 40 feet; thence along said curve through a central angle of 19 461 47" and an arc distance of 13.80 feet; thence North 36 58t 12" West a distance of 30.00 feet to the true point of beginning. The above described land is composed of portions of Parcels Nos. 8, 9, 10, 11, 12, 15, 16, 17, 18 19 aid 20 on Record of Survey Map filed in Book 57, Page 4 4 of Record of Surveys in the office of the County Recorder of the County of Los Angeles; said parcel to be known as "Stamps Avenue." Parcel 2 That portion of Lot 3, Block "F" of Tract 212 in the City of Downey, County of Los Angeles, State of California, as per Map recorded in Book 14, Pages 5 and 55 of Maps, in the office of the County Recorder of said County, described as follows: Beginning at the most Southerly corner of said Lot 3, thence along a line extending from the most Southerly corner of said Lot 3 to the Northwesterly corner of Tract No. 9856 as er Map recorded in Book 140, Pages 24 and 25 of Maps, of said County Recorder; North 53 31' 38" East a distance of 35.31 feet; thence North 36 28 22 x= West a distance of 27 feet; thence North 53 31' 38" East a distance of 159.037 feet to the true point of beginning; thence continuing North 530 31' 38" East a distance of 627.923 feet; thence North 36 581 12" West a distance of 4.00 feet; thence South 53° 31f 38" West a distance of 627.923 feet; thence South 36 ° 581 12" East a distance of 4.00 feet to the true point of beginning. -2- The above described land is composed of portions of Parcels Nos. 15, 16, 17, 18 and 19 on Record of Survey Map filed in Book 57, Page 44, of Record of Surveys in the office of the County Recorder of the County of Los Angeles; said parcel to be known as "Stoakes Avenue." The acquisition of rights of way for storm drain and sanitary sewer purposes, including a temporary easement for con- struction purposes, by gift, purchase, or eminent domain proceedings, consisting in general of the following: Parcel 3 That portion of Lot 4 in Block "F", Tract No. 212, as per map recorded in Book 14, Pages 54 and 55 of Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point in the Southwesterly line of Lot 4, distant South 42 26 37" East along said line 306.48 feet from the most Westerly corner of said Lot 4 to the true point of beginning on a line parallel with and distant Southeasterly 305.08 feet measured at right angles from the Northwesterly line of said Lot 4; thence North 53* Olt 48" East 225.066 feet along said line; thence South 36 58' 12" East 8.00 feet to a line parallel to said Northwesterly line of Lot 4; thence South 53 Olt 48" West 224.298 feet along said line to the Southwesterly line of said Lot 4; thence North 42 26' 27" West along said Southwesterly line 8.037 feet to the true point of beginning. (Drainage and sewer easement.) Parcel 4 That portion of Lot 4 in Block "F", Tract No. 212, as per map recorded in Book 14, Pages 54 and 55 of Maps, in the office of the County Recorder of said County, described as follows: Beginning at a point in the Southwesterly line of Lot 4, distant South 42 26' 37" East along said line 284.38 feet from the most Westerly corner of said Lot 4 to the true point of beginning on a line parallel with and distant Southeasterly 283.08 feet measured at right angles from the Northwesterly line of said Lot 4; thence North 53 Olt 48" East 227.179 feet along said line; thence South 36 581 12" East 22.00 feet to a line parallel to said Northwesterly line of Lot 4; thence South 53° 01t 48" West 225.066 feet along said line to the Southwesterly line of said Lot 4; thence North 42 26 27" West along said Southwesterly line 22.101 feet to the true point of beginning. (Construction easement.) -3- Second: That the public interest and convenience require, and it is the intention of the City Council of the City of Downey to order the following work to be done, to wit, improvement of: Stoakes Avenue between a point 214.45 feet * Northeast of the center line of Gallatin Road to a point 842.38 feet * Northeast of the center line of Gallatin Road, by the grading, preparation of subgrade, construction of asphaltic concrete pavement, construction of cement concrete curbs, gutters, and driveway aprons, and work appurtenant thereto. Stamps Avenue (in the right of way to be acquired therefor) Southwesterly from Vista Del Rio Avenue to the termination of the proposed Stamps Avenue, said work par - ticularly being in Stamps Avenue as proposed, between Vista Del Rio Avenue and a point in Stamps Avenue 862.37 feet l Southwesterly of the center line of Vista Del Rio Avenue, by the grading, preparation of subgrade, construc- tion of asphaltic concrete pavement, construction of cement concrete curbs, gutters, and driveway aprons, the construction and installation of sanitary sewer main, sewer manholes and sewer house laterals, and appurtenant work thereto. An 8 foot wide easement between Gallatin Road and the termination of the proposed Stamps Avenue, said ease- ment being between Gallatin Road and a point 244.39 feet Northeast of the center line of Gallatin Road, by the construction of a concrete box culvert storm drain, fencing, and work appurtenant thereb. Gallatin Road between Stamps Avenue anda point 118 feet Southeasterly of the center line of Stamps Avenue, by the grading, constriction of asphaltic concrete pave- ment, construction of cement concrete driveway aprons, construction of manhole, and work appurtenant thereto. -4- . + Third: The establishment of the grade of said streets and rights of way. SECTION 2. That the district to be benefited by said im- provement and to be assessed to pay the cost and expense thereof and to be known as the assessment district shall be that part of the City of Downey having exterior boundaries as shown on a map of the district, being map No. AD 64 approved by Resolution No. 653 of said City Council adopted August 23, 1960, which map is on file in the office of the City Clerk. Reference hereby is made to the map for a full and complete description of the assessment district, and the map shall govern for all details as to the extent of the assessment district. The estimated cost of construction and acquisition for the project herein described is $55,532.8 SECTION 3. This proposed improvement hereby is referred to the Director of Public Works of said city, and said Director of Public Works hereby is directed to make and file with the Clerk of the Council a report in writing presenting the following: (1) Plans and specifications of the proposed improvement (2) An estimate of the cost of the proposed improvement, including the cost of acquiring the necessary rights of way and of the incidental expenses in connection therewith (3) A diagram showing the assessment district above re- ferred to, which diagram also shall show the boundaries and dimensions of the subdivisions of land within the district as the same existed at the time of the passage of the Resolution of Intention, each of which subdi- visions shall be given a separate number upon said diagram (4) A proposed assessment of the total amount of the cost and expenses of the proposed improvement upon the several subdivisions of land in said district in pro- portion to the estimated benefits to be rdceived by such subdivisions, respectively, from said improve- ments. Said assessment shall refer to such subdivi- sions upon said diagram by the respective numbers thereof. -5- a SECTION 4. That it hereby is determined and declared that serial bonds shall be issued in accordance with Division 7, Streets and Highways Code, said division being the Improvement Act of 1911, to represent each assessment of $50.00 or more remaining unpaid for thirty days after the date of the recording of the dia- gram and assessment for this improvement. The serial bonds shall extend over a period ending nine years from the 2nd day of January next succeeding the next September 1st following their date. The principal sum shall become due and payable in equal annual payments on the 15th day of each October succeeding the next September 1st following their date until fully paid. The first interest payment shall be payable on the 15th day of April next succeeding the March 1st or the 15th day of October next succeeding the September 1st, as the case may be, next following the date of the bonds. The following interest payments each shall be for six months interest and shall be payable on each 15th day of April and October, the last interest payment coming due the October 15th before the last annual payment of the principal. The bonds shall bear interest at a rate to be determined on the sale thereof provided, however, that said rate shall not exceed the maximum rate of six percent per annum. SECTION 5. That if the assessment for this improvement results in a surplus in the improvement fund after the improvement is completed, the surplus shall be refunded or credited prorata to the parties assessed as follows: Where the assessment or any in- stallment has been paid in cash, such credit shall be returned in cash to the owner of the land upon which the assessment was levied as such owner appears from the last equalized assessment roll at the time the refund is made; where the assessment or any installment is unpaid, the credit shall be applied upon such assessment for the earliest unpaid installment or installments of principal and interest. -6- SECTION 6. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect.
