A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DO A2 EY FINDING AND DETERMINING THAT THE PUBLIC
INTEREST, CONVENIENCE AND NECESSITY REQUIRE
THE ACQUISITION OF CERTAIN PROPERTY FOR STREET
PURPOSES (STEM BART AND GRAY ROAD) .
THE CITY COUNCIL OF THE CITY OF D0WNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council hereby finds, determines, and declares
that the public interest and necessity require the acquisition of rights of way in,
over, and under the hereinafter described real property for public street purposes
and all uses appurtenant thereto.
That the location of the land for said street has been P lanned and located
in the manner which will be most compatible to the greatest public good and the
least private injury.
SECTION 2. That the City hereby finds, determines and declares that,
in order to acquire said rights of way in, on, over and under said land for said
street purposes and use the same for said purposes, the public interest, convenience
and necessity require the acquisition of the rights of way by the City of Downey in,
on, over and under that certain real property hereinafter described, and the City
Council hereby declares it is the intention of the City of Downey to acquire in its
name said rights of way, in, on, over and under said hereinafter described real prop-
erty by condemnation in accordance with the provisions of the Code of Civil Procedure
and the Constitution of the State of California authorizing the exercise of the
right of eminent domain.
SECTION 3. That said real property, the acquisition of which is required by
the public interest, convenience and necessity for the purposes set forth in Section
1 and 2 hereof, is described as follows:
Parcel No. 1 - That portion of the northerly forty (40) feet of that portion
of the south 37 acres of the southeast quarter of the northeast quarter of Section
10, Township 3 South, Range 12 West, in the Rancho Santa Gertrudes, in the City of
Downey, county of Los Angeles, state of California, as per map recorded in book 1
page 502 of Miscellaneous Records, in the office of the county recorder of said
county, which lies within that certain parcel of land described in deed to Edward L.
Royal, a married man, recorded as Instrument No. 1491, on September 1, 1950, in
Book 34193 Page 272, of Official Records in the office of said recorder.
To be known as Stewart and Gray Road.

Beginning at the intersection of the southerly line of the above described
Parcel 1 with the westerly line of the easterly fifty (50) feet of said section;
thence westerly along said southerly line seventeen (17) feet; thence southeasterly
in a direct line to a point in said westerly line distant southerly theron seventeen
(17) feet from the point of beginning; thence northerly along said westerly line
to said point of beginning.
To be known as Woodruff Avenue.
Parcel No. 3 - That portion of the northerly forty (40) feet of that portion
of the south 37 acres of the southeast quarter of the northeast quarter of Section
j 10, Township 3 South, Range 12 West, in the city of Downey, county of Los Angeles,
state of California, as shown upon a map of the southwestern portion of the Rancho
Santa Gertrudes, recorded in book 1 page 502 of Miscellaneous Records, in the office
of the county recorder of said county, which lies within that certain parcel of
land described in deed to Holm -Royal Inc., a corporation recorded as Instrument No.
401, on January 2, 1957, in Book 53251, page 448, of Official Records in the office
of said recorder.
To be known as Stewart and Gray Road.
SECTION 4... That the City Attorney of the City of Downey and Burke, Williams
& Sorenson hereby are authorized:, empowered, and directed to prepare, institute
and prosecute in the name of the City of Downey such proceedings in the proper
court having jurisdiction thereof as are necessary for the condemnation of said
rights of way in said real property described in Section 3 of this resolution.
Said attorneys hereby are authorized and empowered to take such procedure as
may be necessary to secure an order of immediate possession for the use and occupancy
of said property, and the deposit of any money by the City necessary therefor, is
hereby approved and authorized.
SECTION 5. The City Clerk shall certify to the adoption of this resolution.
