RESOLUTION NO. 5
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY FINDING AND DETERMINING THAT THE PUBLIC
INTEREST, CONVENIENCE, AND NECESSITY REQUIRE THE
ACQUISITION OF CERTAIN PROPERTY FOR STREET PURPOSES
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council hereby finds, determines,
and declares that the public interest and necessity require the ao
quisition of rights of way in, over, and under the hereinafter de-
scribed real property for public street purposes and all uses ap-
purtenant thereto.
That the location of the land for said street has been
planned and located in the manner which will be most compatible to
the greatest public good and the least private injury.
SECTION 2. That the City Council hereby finds, determines,
and declares that, in ` order to acquire said rights of way in, on,
over and under said land for said street purposes and use the same
for said purposes, the public interest, convenience, and necessity
require the acquisition of the rights of way by the City of Downey
in, on, over, and under that certain real property hereinafter de-
scribed, and the City Council hereby declares it is the intention
of the City of Downey to acquire in its name said rights of way in,
on, over, and under said hereinafter described real property by con-
demnation in accordance with the provisions of the Code of Civil
Procedure and the Constitution of the State of California authoriz-
ing the exercise of the right of eminent domain.

SECTION 3. That said real property, the acquisition of
which is required by the public interest, convenience, and necessity
for the purposes set forth in Sections 1 and 2 hereof, is described
as follows:

Parcel #A That portion of Lot 5, Clock B of Tract No. 212, in the City of
Downey, County of Los Angeles, State of California, as per map recorded
in Book 14, Pages 54 and 55, of Maps, in the office of the County Recorder
of said County, described as follows:
Beginning at the most Westerly corner of Lot 24, Tract No. 14179,
as recorded in Book 362, Pages 31'.33, of Maps, in said County; thence
South 29 ° 35'38" West to the Southwesterly line of said Lot 5; thence
North 59 ° 05'35" West 125 feet to the most Westerly corner of said
Lot 5; thence North 29 ° 35'38" East to a line that is parallel with and
distant 18 feet measured at right angles from the Southwesterly line
of said Lot 5; thence South 59 05'35` East 125 feet along said parallel
line to the point of beginning.
Parcel #B That portion of Lot 2 in Block B of Tract No. 212, in the City of
Downey, County of Los Angeles, State of California, as per map recorded in
Book 14, Pages 54 and 55 of Maps in the office of the County Recorder of
said Count described a

Beginning at a point along the Southwesterly prolongation of the
Southeasterly line of Lot 8, Tract No. 17734, recorded in Book 438,
Page 46, of said County; said point being distant South 31 ° 18'39" West
232 feet from the most Southerly corner of said Lot; thence North
59 0 05'46" West 111.35 feet along a line that is parallel with and
distant
18 feet measured at right angles from the Southwesterly line
of said Lot 2 to a point on the Southwesterly prolongation of the
Northwesterly line of said Lot 8; thence South 31 18'03" West 3 feet
along said Southwesterly prolongation to a line that is parallel with
and distant 15 feet measured at right angles from the Southwesterly
line of said Lot 2; thence South 59 East 111.45 feet thereon to
the Southwesterly prolongation of the Southeasterly line of said Lot 8;
thence North 31 18'39" East 3 feet along said Southwesterly p tongation
to the point of beginning.

Beginning at the most Southerly corner of Lot 10; thence North 59 ° 05'20"
West 47.40 feet; thence Northerly 23.45 feet along a tangent curve concave
to the East having a radius of 15 feet, (through an angle of 90 to
its point of tangency with the Northwesterly line of said Lot; thence
North 31 ° 18 1 40" East 3 feet thereon to the point of tangency with a
curve concave to the East; thence Southerly 23.45 feet along said curve
having a radius of 15 feet; (through an angle of 90 ° 24 1 ), to a tangent
line that is parallel with and distant 3 feet measured at right angles
from the Southwesterl line of

as follows:
Beginning at the most Southerly corner 8f Lot 9; thence along the
Southwesterly line of said Lot North 59 05'20" West 62.50 feet to the
Northwesterly line of said Lot; thence North 31 ° 18 1 40" East 3 feet thereon
to a line that is parallel with a &d distant 3 feet from the Southwesterly
line of said Lot; thence South 59 05'20" East 62.50 feet along said
parallel line to the Southeasterly line of said Lot; thence South
31 ° 18 1 40" West 3 feet to the point of beginning.

Parcel #E That portion of Lot 2, Tract No. 4340, in the City of Downey,
County of Los Angeles, State of California, as per map recorded in
Book 47, Page 29 of Maps, in the office of the County Recorder of said
County described as follows:
Beginning at a point in the Northeasterly line of Lot 2, distant
thereon North 59 05'20" West 200.84 feet from the most Easterly
corner of said Lot, said point also being the intersection of the
Southwesterly line of Florence Avenue, formerly Clara Street,
• formerly Vernon and Downey Road, with the Northwesterly line of
Western Avenue, 50 feet wide; thence continuing North 59 ° 05'20`
West parallel with the Northwesterly line of said Western Avenue
to a line that is parallel with and distant 18 feet measured at
right angles from the Northeasterly line of said lot; thence
59 ° 05'20" East 134.90 feet along said parallel line to its poont
of tangency with a curve concave Westerly; thence Southeasterly
23.66 feet along said curve having a radius of 15 feet; (through
an angle of 90 22` to its point of tangency with the North-
westerly line of Western Avenue; thence North 31 ° 21'40" East
along said Northwesterly line to the point of beginning.
SECTION 4. That the City Attorney of the City of Downey
and Burke, Williams & Sorensen hereby are authorized, empowered, and
directed to prepare, institute, and prosecute in the name of the
City of Downey such proceedings in the proper court having jurisdic-
tion thereof as are necessary for the condemnation of said rights
of way in said real property described in Section 3 of this resolu-
_ tion.
Said attorneys hereby are authorized and empowered to take
such procedure as may be necessary to secure an order of immediate
possession for the use and occupancy of said property.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
