HomeMy WebLinkAboutResolution No. 485 'o9 RESOLUTION NO. 0 2 s --- RESOLUTION DEEERM1NING FEASIBILITY OF PROJECT, WAIVING DEBT LIMITATION, AND OVERRULING PROTESTS FIRESTONE BOULEVARD IMPROVEMENT DISTRICT NO. 20 WHEREAS, a public hearing was duly and legally called and held by the City Council of the City of Downey, California upon the Investigation Report of RICHARD G. aARHITE, Superin- tendent of Streets in the Firestone Boulevard Improvement District No. 20 on September 22, 1959, at which time said report was first read in full; and WBEREAS, all protests made in writing or orally to said proposed improvement were duly and legally considered; and WHEREAS, said Superintendent of Streets has advised that said protests, both oral and written, were not made by owners of more than half of the area of the property proposed to be assessed for said proposed work and improvement, and said City having acquired jurisdiction to proceed herein: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Downey, California in regular session assembled this 22nd day of September, 1959 that all of said protests, both oral and in writing, be and the same hereby are overruled and denied. BE IT FURTHER RESOLVED that said City Council hereby finds that said proposed project is feasible,that the public interest, convenience and necessity require said proposed work -1- 710 and improvement, that the lands to be assessed will be able to carry the burden of the proposed assessments and the limitations upon the amount of assessments provided for in the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", Division 4 of the Streets and Highways Code of the State of California, shall be disregarded, both with respect to the limitations on the district as a whole and as to the limitations on individual specific assessments. BE IT FURTHER RESOLVED that proceedings for said im- provement shall be taken under the "Improvement Act of 1911" of the State of California, Division 7 of the Streets and Highways Code, and improvement bonds shall be issued pursuant to the provisions of said Improvement Act. BE IT FURTHER RESOLVED that the Clerk o f said city y be and she hereby is directed to endorse upon said Investiga- tion Report the approval thereof by this City Council.
