685 RESOLUTION OF INTENTION NO. .--- IN THE MATTER OF THE CONSTRUCTION AND INSTALLAT ION OF AN ORNAMENTAL ELECTRIC LIGHTING SYSTEM AND ELECTRIC TRAFFIC SIGNALS IN THE FIRESTONE BOULEVARD IMPROVEMENT DISTRICT NO. 20 The City Council of the City of Downey, California, in regular session assembled this 20th day of August, 1959, does hereby resolve and determine as follows: SECTION 1: That the public interest and conven- ience require, and that it is the intention of said City Council to order the following work to be done or improve- ments to be made in said City of Downey, to-wit: (a) The construction and installation of an ornamental electric lighting system, including trenching, backfilling, conduit and wiring, ornamental standards with globes and light bulbs, concrete bases, pull boxes, appurten- ances and appurtenant work, in and along: (1) 2nd Street from a point therein 5 feet west of the westerly right of way line of La Reina Avenue to Brookshire Avenue. (2) 3rd Street from a point therein 5 feet west of the westerly right of way line of La Reina Avenue to existing power pole number 899029E, located in 3rd Street, 160 feet east of the easterly right of way line of Dolan t ee e s o e s erly r gh o w y l o Dol Street. (3) Firestone Boulevard from a point 25 feet west of the westerly right of way line of Paramount Boulevard to a point in Firestone Boulevard 10 feet east of the easterly right of way line of Brookshire Avenue, the existing standards II I at the Paramount Boulevard and Dolan Street intersections to remain in place, subject to modifications. (4) Myrtle Avenue from Firestone Boulevard to existing power pole number 1128477E in Myrtle Avenue, 126 feet south of the center line of Firestone Boulevard. (7) Downey Avenue from its intersection with the northerly right of way line of Firestone Boulevard to a point in Downey Avenue 160 feet south of the southerly ..-. right of way line of Firestone Boulevard. (8) Dolan Street from 2nd Street to a point in Dolan Street, 7 feet south of the northerly right of way line of 3rd Street. (9) Brookshire Avenue at its intersection with 2nd Street and with Firestone Boulevard. (b) The construction and installation of electric traffic signals, together with appurtenances and appurtenant ands work, upon the electric standards hereinabove referred to d r upon Firestone Boulevard at its intersections with Paramount Boulevard, La Reina Avenue, Downey Avenue, Dolan Street and Brookshire Avenue, existing traffic signals at any of said intersections to remain in place, subject to modification. SECTION 2: All of the above mentioned work, in- cluding the grade to which said work shall be done and the location thereof in and upon the streets above mentioned, shall be done upon the grades, along the lines, between the P � �► g points, of the dimensions at the . P � � laces and in the manner P described and set forth in the plans, profiles and detailed drawings of said work, and to specifications for said work heretofore adopted by said City Council on August 20, 1959 by its Resolution No. - �- = f , , which plans, profiles, detailed drawings and specifications are on file in the office of the City Clerk of said city, and which are hereby referred to for a more particular description of said work, grade of said work, -2- and location of said work in and along the streets herein- before mentioned; and which said plans, profiles, detailed drawings and specifications are hereby incorporated herein and made part hereof by reference as though set forth fully herein. SECTION 3: That said contemplated work and im- . provements, in the opinion of said City Council, is of more than local or ordinary public benefit, and that the expenses and cost of said work and improvements shall be chargeable upon a district, which said district said City Council hereby declares to be the district benefited by the work and im- provements herein described and to be assessed to pay the cost and expenses thereof; said district shall include that territory in said City of Downey which is shown upon that certain plat or map thereof on file in the office of the City Clerk of said city, entitled "CITY OF DOWNEY -MAP SHOWING THE EXTENT OF THE TERRITORY TO BE INCLUDED IN ASSESSMENT DISTRICT NO. 20," and which said map or plat indicates by a boundary line the extent of the territory included in the proposed district and covers all details as to the extent of the area to be assessed; said map or plat is hereby incorporated herein and made a part hereof by reference as though set forth fully herein. The real property within said assessment district owned by the United States of America, as fully described in the Investigation Report on file in this proceeding in the office of the City Clerk of said City of Downey and referred to in said report as Parcel Number 52, reference to which -3- • 688 Investigation Report is hereby made for further particulars, shall be omitted from the assessment to be hereafter made to cover the cost and expense of the work herein proposed. SECTION 4: Notice is hereby given that serial bonds shall be issued in the manner and form provided in Part 5, Division 7 of the Streets and Highways Code of the State of California, the Improvement Act of 1911, to represent unpaid assessments of Fifty Dollars ($50.00) or over, which said bonds shall bear interest at the rate of six (6 %) percent per annum and the last installment b llme of which bonds shall mature nine (9) years from the second day of January next succeeding the next October fifteenth following their date. SECTION 5: Not ice is hereby given that on Tuesday, the 22nd day of September, 1959 at the hour of 8 :15 o'clock A.M. of said day, in the council chambers in the City Hall of said City of Downey, the meeting place of said City Council, any and all persons having any objections to the proposed work or improvements, or any objections to the grades to which said work is to be done, or any objections to the boundaries of the district proposed to be assessed to pay the cost and expenses of said work or improvements, may appear before said City Council and show cause why said proposed work or improvements should not be carried out in accordance with this resolution of in- tention, and may present written protests in the form and '-' manner required by law not later than the hour hereinabove set for hearing objections against the doing of said work, the grades to which said work is to be done, or the extent of the territory to be assessed to pay the cost and expenses thereof. -4- 1 --- , _ 6E8 SECTION 6: The City Clerk of said city shall cause this resolution of intention to be published twice I j in the DOWNEY LIVE WIRE, a newspaper of general circulation, — published and circulated in said City of Downey, which said newspaper has heretofore been e designated by said City Council as the newspaper in which shall be printed and published all notices, resolutions, orders and other matters required to be published in the proceedings to be taken pursuant to this resolution and under the provisions of the Improvement Act of 1911, and amendments thereto; the first publication of said notice shall be not less than ten (10) days prior to the date herein fixed for the public hearing fixed by this resolution of intention. SECTION 7: The Superintendent of Streets of said city shall cause to be conspicuously posted along the line of said contemplated work and improvements, and on all the open streets within the assessment district, notice of the passage of this resolution of intention, in the time, form and manner required by law. SECTION 8: The City Clerk of said city is hereby directed to mail notices of the adoption of this resolution of intention, postage prepaid, to all persons owning real property proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last -- equalized assessment roll for real property taxes, or as known to said City Clerk. Said mailing is to be completed at least fifteen (15) days prior to the day herein fixed for the public hearing on this resolution of intention, all in the time, form -5- 690 and manner prescribed in said Improvement Act of 1911, as amended. SECTION 9: The total estimated cost of said work and improvements, including estimated incidental costs, is in the amount of $99,637.00. SECTION 10: NOTICE ICE IS HEREBY FURTHER GIVEN that the grades to which said work is to be done are, or may be in part, new and different from those heretofore established, or may be and in some cases are different from existing ground levels. SECTION 11: NOTICE IS HEREBY FURTHER GIVEN that the report of the Superintendent of Streets of the City of Downey upon the proposed improvement, as approved by said City Council, is on file in the office of the City Clerk of said City of Downey, and open to public inspection.
