' o A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING EMINENT DOMAIN PROCEEDINGS FOR THE ACQUISITION OF NECESSARY RIGHTS OF WAY AND THE CONSTRUCTION OF CERTAIN IMPROVEMENTS IN ASSESSMENT DISTRICT 18 (TENTH STREET) ,-r WHEREAS, the City Council of the City of Downey, on April 14, 1959, adopted Resolution of Intention No. 412, under and pursuant to the provisions of the Municipal Improvement Act of 1913, determining that the public interest, convenience, and necessity require, and declaring its intention to order the acquisition of necessary rights of way and the construction of certain improvements set forth in said resolution in Downey Assessment District No. 18 (Tenth Street); and WHEREAS, the City Council has confirmed the diagram and assess- ment for this improvement, and said diagram and assessment have been recorded in the office of the Superintendent of Streets; and WHEREAS, the City Council, on July 28, 1959, adopted Resolution No. ordering that rights of way be acquired and the improve- ment be made, all as set forth in Resolution of Intention No. 412; and WHEREAS, the City Treasurer has established a Special Fund Account known as the "Improvement Fund for Assessment District No. 18 (Tenth Street);" NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Attorney and the firm of Burke, Williams & Sorensen hereby are authorized and directed, in the name of the City of Downey, to institute eminent domain proceedings in the Superior Court of the State of California in and for the County of Los Angeles and to file suit in condemnation for the acquisition of ---- the necessary rights of way for public road purposes, all in accord- ance with Resolution of Intention No. 412 and the report for Downey Assessment District No 18. SECTION 2. That the public convenience and necessity -1- 663 require the taking of immediate possession, and said attorneys hereby are directed to institute proceedings, procure the right of immediate possession, and for the taking of immediate possession and use of the property herein ordered to be acquired, upon complying with the re- quirements of the law applicable thereto, and said attorneys hereby are ordered and directed to report to the City Council the amounts of money required as soon as the same reasonably may be ascertained. SECTION 3. That the rights of way to be acquired are lo- cated in the City of Downey, County of Los Angeles, State of Cali- fornia, and are particularly described as follows: Parcel 1 That certain real property in the City of Downey, County of Los Angeles, State of California, being that portion of the Rancho Santa Gertrudes in the City of Downey, County of Los Angeles, State of California, bounded by the following de- scribed lines: Beginning at the most westerly corner of Tract #7235 as shown on map recorded in Book 78, page 92 of Maps in the office of the County Recorder of said county, said most westerly corner being the most northerly corner of the land described in Certificate or Title No. K -6818, on file in the office of the Registrar of Titles of said county; thence along the southwesterly line of said Tract #235, and the northeasterly line of said land, South 58°43'45" East 876.38 feet to the most easterly corner of the land conveyed to Edward J. Farrell and Lillian E. Farrell by document No. 5286 -N registered April 3, 1945 in the office of the Registrar of Titles of said county; thence along the south- easterly line of the land of Farrell South 31 ° 42135" West 25 feet; thence parallel to said southwesterly line of Tract #7235, North 58°43 West 876.11 feet to the northwesterly line of the land conveyed to William M. Hargis and Thelma P. Hargis by deed recorded August 23, 1954, in Book 45380, page 325, Official Records in the office of said county recorder; thence along said northwesterly line North 31 °22'25" East 25 feet to the point of beginning. Parcel 2 That certain real property in the City of Downey, County of Los Angeles, State of California, being that portion of Tract No. 7235 recorded in Book 78, page 92, Official Records in the office of the County Recorder of said county, described as follows: Beginning at the most westerly corner of Lot 4 of said tract; thence along the southwesterly line of said Lot 4 South 58 °43145" East 17 feet; thence in a straight line 24.04 feet to a pdnt that is in the northwesterly line of said lot and North 31 East 17 feet from the point of be ginning; thence South 31 West 17 feet to the point of be - ginning. Parcel That certain real property in the City of Downey, County of Los Angeles, State of California, being that portion of Tract -2- 6 No. 7235 recorded in Book 78, page 92, Official Records in the office of the County Recorder of said county described as fol- lows: Beginning at the most southerly corner of Lot 20 of said tract; thence along the southwesterly line of said Lot 20 North 58 Vest 17 feet; thence in a straight line, 24.04 feet to a point that is in the southeasterly line of said lot and North 31 °59130" East 17 feet from the point of beginning; thence South 31 Nest 17 feet to the point of beginning, said parcels to be known as Tenth Street. SECTION 4. The City Clerk shall certify to the adoption of this resolution.
