RESOLUTION NO. 549
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY DECLARING ITS INTENTION TO IMPROVE STAMPS
AVENUE AND OTHER STREETS AND RIGHTS OF WAY IN THE
CITY OF DOWNEY, DETERMINING THAT BONDS SHALL BE
ISSUED TO REPRESENT THE COST THEREFOR, DECLARING
THE WORK TO BE MORE THAN LOCAL OR ORDINARY PUBLIC
BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE
ASSESSED UPON A DISTRICT.
WHEREAS, there is on file in the office of the City Clerk of said
city a report made and filed pursuant to the provisions of Division 4
of the Streets and Highways Code of the State of California; and
WHEREAS, the City Council of said city, by resolution No. 548
adopted the 12th day of January, 1960 approved the report and set a
hearing thereon:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE
AS FOLLOWS:
SECTION 1. That the public interest, convenience, and necessity
require, and it is the intention of the City Council, pursuant to the

provisions of Section 5102 of the Streets and Highways Code, to order the
acquisition of rights of way for street purposes by gift, purchase, or
eminent domain proceedings, consisting, in general of the following parcels:
That certain real property in the City of Downey, County of
Los Angeles, State of California, described as:
Parcel 1: That portion of Lot 4, Block "F" of Tract 212,
in the City of Downey, County of Los Angeles, State of
California, as per map recorded in Book 14, pages 54 and
55 of Maps in the office of the County Recorder of said
county, described as follows:
Beginning at the most westerly corner of said Lot 4,
Block "F' of Tract 212; thence along the northwesterly
line of said Lot 4, North 53 east a distance of
254.288 feet to the true point of beginning; thence south
36 east a distance of 7.00 feet; thence north
53 east a distance of 557.452 feet; thence north

That the public interest, convenience, and necessity
require, and it is the intention of the City Council, pursuant to
the provisions of Section 5102 of the Streets and Highways Code,
to order the acquisition of rights of way for storm drain and sani-
tary sewer purposes, including a temporary easement for construction
purposes, by gift, purchase, or eminent domain proceedings, consist-
ing, in general, of the following parcels:
That certain real property in the City of Downey, County
of Los Angeles, State of California, described as:
Parcel 4: That portion of Lot 4 in Block "F ", Tract No.
212, — as per map recorded in Book 14, pages 54 and 55 of
Maps, in the office of the County Recorder of said county,
described as follows:
Beginning at a point in the southwesterly line of
Lot 4, distant south 42 ° 26 1 37" east along said line 306.48

•-• That the public interest and convenience require, and it
is the intention of the City Council of the City of Downey to order,
the following work to be done, to wit: the improvement of:
Stamps Avenue between Vista Del Rio Avenue and a point
750 feet &southwesterly from Vista Del Rio Avenue by the
grading, preparing of subgrade, and the construction of
concrete curb and gutter, asphaltic concrete pavement,
concrete driveway aprons, main line sanitary sewer,
sewer house laterals, and appurtenant work thereto;
Gallatin Road between Stamps Avenue and a point 125 feet
southeasterly of Stamps Avenue, and gallatin Road between
Stoakes Avenue and a point 93 feet - northwesterly of
Stoakes Avenue by grading, preparing of subgrade, con-
struction of asphaltic concrete pavement, concrete curb
and gutter, and appurtenant work thereto;
Stoakes Avenue between Gallatin Road and Vista Del Rio
Avenue by the grading, preparing of subgrade, construction
of concrete curb and gutter, asphaltic concrete pavement,
concrete driveway aprons, and work appurtenant thereto;
Downey Avenue between Vista Del Rio Avenue and a point
125 feet — southwesterly of Vista Del Rio Avenue by grad-
ing, preparing of subgrade, construction of concrete curb
and gutter, asphaltic concrete pavement, concrete drive -
way apron, and appurtenant work thereto;

Vista Del Rio Avenue between Downey Avenue and Stoakes
Avenue by grading, preparing of subgrade, construction of
concrete curb and gutter, concrete driveway apron, asphal-
tic concrete pavement, and work appurtenant thereto;
The drainage easement described as "Parcel 4" h reinabove,
said easement lying parallel with and 330 feet - from
Downey Avenue between Gallatin Road and a point north-
easterly 2 feet w to the southwesterly terminus of
Stamps Avenue as described in
p parcel 2 hereinabove, by
the construction of sanitary sewer main, concrete covered
storm drain channel, chain link fence , appurtenant
and a urtenant
work thereto.
That all of the foregoing work and acquisition shall be
done in accordance with the profile and improvement plan No. 1 -11 -79

and any supplemental drawings mentioned thereon, which said profile
and improvement plan was adopted by Resolution No. .S46 of the
City ouncil on January 12 1960, and is on file in the office of

ASSESSMENT DISTRICT NO. 24 •
STAMPS AVENUE
BETWEEN GALLATIN ROAD AND
VISTA DEL RIO
which was adopted by Resolution No. of the City Council on
January 12, 1960.
The work and improvement herein described shall be con -
structed to the grades, subgrades, and elevations severally shown
upon said profile and improvement plan No. 1 -11 -79 and detailed
drawings thereon, in the respective locations thereof. Reference
hereby is made to the profile and improvement plan No. 1 -11 -79 for
a description of the grades to which all the work and improvements
under this Resolution of Intention shall be done, which said grades
hereby are adopted and established as the official grades therefor,
for all purposes in connection with the proceedings pursuant to
this Resolution of Intention. Notice hereby is given that said
grades are or may be, in part, new and different from those hereto-
fore established or existing, or may be, and in some cases are,
different from existing ground levels.

SECTION 2. The estimated cost of this improvement is
$62, 545.70.
That said proposed work or improvement, in the opinion of
the City Council of the City of Downey, is of more than local or
ordinary public benefit, and the Council hereby proposes that the
district in the City of Downey to be benefited by said work or im-
provement and to be assessed to pay the cost and expenses thereof
is shown on that certain plan or map No. A.D. 24, indicating the
exterior boundary thereof, approved by Resolution No. of
the City Council on January 12, 1960, and on file in the office of
the City Engineer. Said plan or map hereby is referred to and shall
govern for all details as to the extent of the assessment district.
The assessment district includes, in eneral, the lots and parcels

of land abutting upon or contiguous to the hereinabove described
streets and easements, but reference hereby is made to said plan or
map for all details as to the extent of said assessment district and
for any variation between the last mentioned general description and
the extent of the assessment district as shown on the plan or map.
All public streets or alleys, or portions thereof, hereby are ex-
cepted from said district.
SECTION 3. That serial bonds, bearing interest at the
rate of 6% per annum, shall be issued to represent each assessment
of $50.00 or more remaining unpaid for thirty (30) days after the
date to f the o e recordation of the warrant Said serial bonds S is on s shall
extend over a period ending nine (9) years from the second day of
January next succeeding the next September 1st following their date.
Payments on the principal of unpaid assessments and interest shall
be made by property owners to the City Treasurer, and the sums shall
be disbursed by him or as provided in the Improvement Act of 1911
hereinafter referred to.
SECTION 4. Notice hereby is given that on February 23,
1960, at 8:00 o'clock A.M., in the Council chamber of said city in
the City Hall located at 8425 Second Street, Downey, California,

any and all persons having any objection to the proposed work or
improvement, to the extent of the assessment district, or both,
may appear before the City Council and show cause why the proposed
work or improvement should not be carried out in accordance with
this Resolution of Intention. Protests must be in writing, must
contain a description of the property sufficient to identify it,
and must be delivered to the City Clerk not later than the hour set
for hearing.
SECTION 5. The Superintendent of Streets immediately shall
cause notice of the passage of this Resolution of Intention to be
posted conspicuously along the line of the contemplated work or im-
provement and along all the open streets within said district, in
the manner and form prescribed by law.
The City Clerk hereby is directed to mail notices, in the
manner and form prescribed by law, of the adoption of this resolu-
tion to all persons owning real property in the hereinbefore de-
scribed assessment district, whose names and addresses appear on
the last equalized assessment roll for City taxes or as known to
the City Clerk.

making the improvement and in doing the work prescribed herein,
elects to proceed under and in accordance with the provisions of
the Improvement Act of 1911, being Division 7 of the Streets and
Highways Code of the State of California.
SECTION 7. The City Clerk shall certify to the adoption
1 of this Resolution of Intention and shall cause the same to be
published twice in the `Downey Live Wire," a newspaper published
and circulated in the City of Downey, the first of which publica-
tions shall be not less than ten (10) days prior to February 23,
1960, the date of said hearing, and which hearing shall be not less
than fifteen ( 15) , nor more than sixty (60) days after the date of
adoption of this resolution.
SECTION 8. The City Clerk shall certify to the adoption

of this resolution, and thenceforth and thereafter the same shall
be in full force and effect.
