HomeMy WebLinkAboutResolution No. 451 650 fi RESOLUTION NO. _`l" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE 1958 STORM DRAIN BOND ISSUE PROJECT NO. 409 AND GRANTING PERMISSION TO THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT TO CONSTRUCT AND MAINTAIN SAID STORM • DRAIN WITHIN THE PUBLIC STREETS IN THE CITY OF DOWNEY .-, WHEREAS, the Los Angeles County Flood Control District proposes the construction of a storm drain within public streets in.the City of Downey; and WHEREAS, the traveling public and adjoining property owners are entitled to reasonable access, convenience, and safety from the hazards of excavation within the public streets; and WHEREAS, the Los Angeles County Flood Control Act provides that any work or improvement provided for in this act may be located, constructed and maintained in, along, or across any public road or highway in the County of Los Angeles, in such manner as to afford security for life and property and said district shall restore or cause to be restored such road or highway to its former state as near as may be, so as not to impair its usefulness. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS: SECTION 1. The plans and specifications are herewith approved for the construction of the 1958 Storm Drain Bond Issue Project No. 409, northern Bellflower Storm Drain in the Cities of Bellflower and Downey, and authoriza' tion will be granted to the Los Angeles County Flood Control District to proceed with the construction as described therein, and permission granted to the District to occupy and use the public streets within the City of Downey and to operate and maintain said storm drain and appurtenant facilities upon their completion, subject to the following conditions: a. A 1No Fee" excavation permit (enclosed) shall be executed by the Chief Engineer or his duly authorized representative of the Flood Control District, and returned to the City of Downey prior to commencing any work within the City of Downey. b. The herewith approved plans and specifications shall be fol• lowed implicitly as they relate to public safety, traffic control and the reconditioning of all existing street facili- ties. Any deviation therefrom without prior and express approval of the Department of Public Works of the City of Downey shall in effect nullify permission to utilize City streets and shall subject the corporation, organization, and/or agents doing work therein to the penalties set forth in the Downey Municipal Code as they relate to excavating in the public streets without a bona fide permit. c. The contractor shall not store excavated material, con. struction materials or equipment in any parkway (the area between the curb and property line) of any public street, road or highway except where the adjoining property is vacant and the parkway is not in use with plantings, culti. vated vegetation, sidewalks, pathways, or any other man- placed f encroachments (legally permitted or otherwise). d. Track - laying equipment such as bulldozers, skip loaders and trenching machines but not limited thereto, may operate on street pavements (asphalt and /or concrete) provided: 1. The machine is equipped with street pads, and 2. Suitable sized planks are placed beneath the tracks during its movement and operation, or 3. The pavement over which the track..laying equipment is moved or operated is to be replaced, resurfaced, sealed or patched to eliminate all defects and scars resulting from its operation thereon. 6 51 e. The Contractor shall submit to the Police and Public Works Departments, the name, title, address and telephone number (home and business) of as many of his represents- tives as are necessary to insure 24*hour, 7 *days a week (including holidays) coverage in the event an emergency should arise requiring the immediate attention of the Contractor. This list shall be kept correct and current during the period of the contract. 0■ f. Temporary resurfacing shall consist of the specified stock pile premix of a thickness of not less than 2 inches on major highways and a thickness not less than 1 inch on secondary (local) streets. SECTION 2. The City Clerk shall certify to the adoption of this resolu• tion and forward certified copies thereof to Mr. M. E. Salsbury, Chief Engineer, Los Angeles County Flood Control District; Mr. Harold W. Kennedy, Los Angeles County Counsel; Los Angeles County Board of Supervisors, and Mr. Carl Berry, City Administrator for the City of Bellflower.
