A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CON-
VENIENCE, AND NECESSITY REQUIRE THE ACQUISITION OF
CERTAIN PROPERTY FOR STmmisT PURPOSES
THE CITY COUNCIL OF THE CITY OF DOWNEY DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council hereby finds, determines,
and declares that the public interest and necessity require the ac-
quisition in fee of the hereinafter described real property for pub -
lid street purposes and all uses appurtenant thereto.
That the location of the land for said street has been
planned and located in the manner which will be most compatible to
the greatest public good and•the least private injury.
SECTION 2. That the City Council hereby finds,. determines,
and declares that, iti order to acquire said land for said street pur-

poses and use the same for said purposes, the public interest, con-

venience, and necessity require the acquisition of the fee title by
the City of Downey in and to that certain real property hereinafter
described, and the City Council hereby declares it -is the intention
of the City of Downey to acquire in its name the fee title to said
hereinafter described real property by condemnation in accordance
with the
{ provisions of the Code of Civil Procedure and the Constitu-
tion of the State of California authorizing the exercise of the right
of eminent domain.
SECTION 3. That said real property, the acquisition of
which is required by the public interest, convenience, and necessity
for the purposes set forth in Sections 1 and 2 hereof, is described
as follows:
Parcel 1: "That real property in the City Of Downey, County of
Los Angeles, State of California, described as that part Of the Rancho
San t& a Gertrude& finally confirmed to James P. McFarland and John G.
r-, Downey as recorded in Book 1 Page 156 -158 of Patents in the office of
the Count Recorder `of said c oup
Y ty, conveyed to Willism M. Hargis and
Thelma P. Hargis, and Louise Hargis Shiplett, by document No. 615 on
August 23, 1954, in Book 45380, page 325 that lies within the follow-
ing described lines:
-"Beginning at the most westerly corner of Lot 32 Tract 16036 as
recorded in Book 353 Page 25 Official Records in the office of said

County Recorder; thenne.South 32 West, 17.79 feet to the
northeasterly line of Cherokee Drive; thence along said northeast-
' erly line North 57 West 311.51 feet to the true point of be-
ginning; thence parallel with, and distant southeasterly 12 feet when
measured at right angles from the southeasterly line of Brookshire
Avenue as shown on said tract, North 32 East, 1271.41 feet;
thence North 57 West 7.59 feet to the southeasterly terminus
of a line having a length of 4.41 feet and a bearing of North 58°391
West as shown on Tract No. 7235 recorded in Book 78 Page 92 Official
Records in the office of said County Recorder; thence North 57°58145"
West, 36.41 feet to a line that is parallel with and distant 12 feet
• P""' northeasterly when measured at right angles from the northwesterly
line of Brookshire Avenue, thence South 32 West, 1271.38 feet
• to the northeasterly line of Cherokee Drive; thence along last said
northeasterly line 44.0 feet to the true point of beginning."
Parcel 2: "That part of the Rancho Santa Gertrudes in the City
of Downey, County of Los Angeles, State of California, described as
follows:

"Beginning at the most westerly corner of the land conveyed to
Robert Glasband and Ruth Glasband, by document #570 recorded Novem-
ber 14, 1955 in Book 49503 Page 18 Official Reobrds in the office
of the County Recorder of said county, said corner being North 31
19'55" East 8.0 feet, and South 58°440557 East 10.0 feet from a
C.S. Brass Cap Monument per C.S.F.B. 1235-83 as shown on a map of
Tract 20921 recorded August 8, 1956 in Book 602 Page 50 of Maps in
the office of said Recorder; thenee along the northwesterly line of
the said land of Glasband North 31°191557 East to the southwesterly
line of the land 40scribed in deed to Hedwig Sibley, recorded in
Book 9097 Page 199 of Official Records of said county, a distance of
176.73 feet; thence South 58 East along said southwesterly
line, 12.0 feet; thence South 31 19!55 West 150.74 feet to the be-
ginning of a tangent curve concave easterly and having a radius of
18.0 feet; and being also tangent to a line that is parallel with and
emv% distant 8.00 feet northegsterly when measured at right angles from a
line that bears South 58'40155" East from the point of beginning;
thence along said curve 28.28 feet through a central angle of 90
50"; thence along a radial of said curve South 31°191057 West 8.0
feet to the south line of the said land of Glasband; thence North
58 West 30.00 feet to the point of beginning."
SECTION 4. That the City Attorney of the City of Downey
and Burke, Williams & Sorensen hereby are authorized, empowered, and
directed to prepare, institute, and prosecute in the name of the
City of Downey such proceedings in the. proper court having jurisdic-
tion thereof as are necessary for the condemnation of the fee title
to said real property described in Section 3 of this resolution.
Said attorneys hereby are authorized and empowered to take
such procedure as may be necessary to secure an order of immediate

possession for the use and occupancy of said property.
SECTION 5. The City Clerk shall certify to the adoption
of this resolution.
